Դատախազության քայլերն ուղղված են այս իշխանության պաշտպանությանը. Արթուր Ղազինյան

«Մեկ Հայաստան» կուսակցության ղեկավար, Հայրենիքի փրկության շարժման իրավական հանձնախմբի ղեկավար, իրավաբան Արթուր Ղազինյանի խոսքով՝ պետք է ուշադրություն դարձնել կառավարման համակարգի ներսում հակակշիռների ձևավորմանը, ինչպես նաև հայկական շահի վրա հիմնված մարմիններին՝ բանակ, ոստիկանություն, ԱԱԾ, որոնք, ըստ նրա, պետք է գործեն օրենքով ու Սահմանադրությամբ իրենց գործառույթների, ոչ թե քաղաքական իշխանության քմահաճույքների տիրույթում:

Ըստ Ղազինյանի՝ եթե Գլխավոր շտաբը գործեր Սահմանադրությամբ ու օրենքներով իրենց տրված լիազորությունների տիրույթում, ապա հոկտեմբերի առաջին տասնօրյակում չէինք ունենա Նիկոլ Փաշինյան անուն-ազգանունով վարչապետ, այլ նա կլիներ որևէ զինվորական կառույցում՝ որպես բանտարկյալ: Ու դա անելը, ըստ Ղազինյանի, ԳՇ պետի պարտքն էր:

«Մեկ Հայաստան» կուսակցության ղեկավարի խոսքով՝ սա դավաճանական քայլի ևս մեկ ապացույց է, ու ըստ նրա՝ այսօր բոլորն են խոսում դավաճանության մասին, բայց դատախազությունն իրեն դրսևորում է՝  որպես քաղաքական կառույց:

«Մի մասը դա ասում է ուղղակիորեն: Իրավաբանները դա ասում են՝ հաղորդում ներկայացնելով հանցագործության մասին: Եթե ամբողջ իրավաբանական մասնագիտական հանրույթը՝ պրոֆեսիոնալ և պրակտիկ և գիտաակադեմիական, մի կարծիք ունեն և մի ձայնով գոռում են, որ տեղի է ունեցել պետական դավաճանություն, և դավաճանը, գլխավոր դավաճանը պետք է ձերբակալվի՝ գոնե նոր դավաճանությունները խափանելու նպատակով, քաղաքական գործիչների մի մասն ուղիղ խոսում են, որ եղել է  պետական դավաճանություն, նախագահներն անուղղակիորեն ասում են դրա մասին, որովհետև ուղիղ չեն ասում պետական դավաճանության մասին, բայց նրանց ցանկացած արտահայտած միտք իր մեջ պարունակում է նոր հաղորդում հանցագործության մասին, որը պետք է հարուցվի պետական դավաճանության հոդվածով:

Դատախազությունը, նորից եմ կրկնում, քաղաքական մարմին է դարձել: Նրանք իրավունքից էնքան են հեռացել: Դուք որ տեսնեք՝ ինչպես են որոշումները կայացնում, և ինչպիսի արհամարհանք կա դատավարական ժամկետների, թե ինչպես են ծաղրում… Երբ որ դիմումատուն՝ հանցագործության մասին հաղորդում ներկայացնող անձը, մասնագիտությամբ իրավաբան է, դեռ ավելին՝ գիտությունների թեկնածու, դոցենտ, դոկտոր, պրոֆեսոր, ակադեմիկոս, կամ, ասենք, վաստակաշատ փաստաբաններ, նախկին դատախազներ, նախկին քննիչներ, քննչական մարմինների ղեկավարներ, մի ձայնով գտնում են, որ սա հանցագործություն է, տալիս են հաղորդում հանցագործության մասին, իրենք ցինիկաբար, իրավունքի և օրենքի կոպիտ խախտումով, հանցավոր անգործություն ցուցաբերելով՝ հրաժարվում են քրեական գործ հարուցել, ինչ-որ բան են հորինել, կցել ինչ-որ հարուցված քրեական գործի: Նման դատավարական ընթացակարգ օրենքով նախատեսված չի: 3 հաղորդում է  ներկայացվել, 3-ի պարագայում էլ տարել են, կցել են նոյեմբերի 19-ին հարուցված ինչ-որ մի քրեական գործի հետ, որն ընդամենը 20% է առնչվում այն նյութերին, որ տրվել է այս 3 հաղորդումների մեջ: Այսինքն՝ իրենք տանում են քաղաքական աջակցության պայքար, որն ուղղված է այս իշխանության պաշտպանությանը»,- ասաց Արթուր Ղազինյանը:
