Միջազգային քրեական դատարանը որոշում է կայացրել Պաղեստինի տարածքների վերաբերյալ

Միջազգային քրեական դատարանի (ՄՔԴ) դատավորները եզրակացրել են, որ իրենց դատարանն ունի անհրաժեշտ իրավասություն՝ Պաղեստինի տարածքներում ռազմական հանցագործությունների մեղավորների նկատմամբ դատավճիռներ կայացնելու համար: Սա հնարավորություն է ստեղծում քրեական հետաքննության իրականացնելու համար, տեղեկացնում է Ամերիկայի ձայնը:

 

Դատավորներն ասել են, որ իրենց որոշումը հիմնված է այն փաստի վրա, որ Պաղեստինը մասնակից է եղել միջազգային դատարանի՝ Միջազգային քրեական դատարանի Հռոմի ստատուտի ստեղծման համաձայնագրի: Նրանք նշել են, որ ՄՔԴ իրավասությունը տարածվում է «Իսրայելի կողմից 1967 թվականի վեցօրյա պատերազմից հետո գրավված տարածքներում, մասնավորապես Գազայի հատվածում և Հորդանան գետի արևմտյան ափին, ներառյալ Արևելյան Երուսաղեմում»: Դատավորները նաև նշել են, որ իրենց որոշումը Պաղեստինի պետական կարգավիճակը կամ դրա սահմանները որոշելու փորձ չէ:

 

Իսրայելը, որը ՄՔԴ անդամ չէ, դատապարտեց այս որոշումը, իսկ Պաղեստինի ինքնավարությունը ողջունեց այն:

 

Իսրայելի վարչապետ Բենյամին Նեթանյահուն տեսաուղերձում հակասեմականություն է որակել ՄՔԴ-ի կողմից Իսրայելին հետաքննելու փորձը ՛՛կեղծ ռազմական հանցագործությունների՛՛ մեղադրանքով: Նա դատապարտեց դատավորների որոշումը ՝ նշելով, որ Իսրայելն իրեն պաշտպանում է ահաբեկիչներից այն ժամանակ, երբ դատարանը հրաժարվում է հետաքննել դաժան բռնապետությունների հետ կապված գործեր, որոնք ղեկավարում են Իրանն ու Սիրիան:
