Գործարքին խանգարելու հերթական փորձը տապալվեց. դատարանը մերժեց Յուքոմի հայցի ընդունումը

DataLex դատական տեղեկատվական համակարգից տեղեկանում ենք, որ Հայաստանի Հանրապետության Վարչական դատարանը որոշում է կայացրել «Յուքոմ» ՓԲԸ ներկայացված հայցադիմումի ընդունումը մերժելու մասին:

«Յուքոմ» ՓԲԸ ներկայացուցիչ Արամ Օրբելյանի կողմից 16.09.2020 թվականին հայցադիմում է ներկայացվել Դատարան ընդդեմ ՀՀ ՏՄՊՊՀ՝ նրա 09.07.2020 թվականի թիվ 282-Ա որոշումը վերացնելու պահանջի մասին, որով հավանություն էր տրվել «Թիմ» ՍՊԸ կողմից Վեոն Արմենիա ՓԲԸ-ն ձեռքբերելու վերաբերյալ։

Մերժելով հայցադիմումի ընդունումը՝ դատարանը, մասնավորապես, նշել է.
«Հայաստանի Հանրապետության վարչական դատավարության օրենսգրքի 80-րդ հոդվածի 1-ին մասի 4-րդ կետի համաձայն` վարչական դատարանը մերժում է հայցադիմումի ընդունումը, եթե հայցադիմում է ներկայացրել դրա իրավունքն ակնհայտորեն չունեցող անձը»:

Հիշեցնենք, որ Յուքոմի ներկայացուցիչները երեք անգամ հայց են ներկայացրել ՀՀ վարչական դատարան՝ պահանջելով վերացնել ՀՀ ՏՄՊՊՀ 09.07.2020 թվականի թիվ 282-Ա որոշումը։ Առաջին երկու հայցադիմումները (22․07․2020 և 03․09․2020) «Յուքոմ» ՓԲԸ-ն հետագայում ինքն էր խնդրել վերադարձնել, իսկ վերջին, երրորդ հայցադիմումի ընդունումը մերժվեց ՀՀ վարչական դատարանի կողմից երեկ կայացված որոշմամբ (որը հասանելի է այստեղ)։
