1982-1983 թ.թ. ԻՆՉՊԵՍ ԵՂԵԼ Է. Էջմիածնում մայրն իր 12-ամյա աղջկան ծեծել և հանձնել է սիրեկանին, որ բռնաբարի

1in.amԽորհրդային տարիներին հանցագործությունների մասին սուղ տեղեկատվություն էր տրվում, այն էլ՝ գրաքննության «թրի տակով» անցկացնելուց հետո: Գաղտնիության քողով ծածկված՝ հանցավոր շատ արարքներ մնում էին չլուսաբանված, հանրության դատին չներկայացված: Դրանց մասին կարող էին խոսել տեղական՝ թաղային-հարևանական մակարդակով: Հետո ժամանակն անցնում էր, ասեկոսեները մոռացվում էին, թվում էր՝ որոշ հանցատեսակներ ընդհանրապես գոյություն չունեն դեպի կոմունիզմ շտապող երկրում: Բայց ժամանակի միջով անցած ու պահպանվող փաստաթղթերը, դատական ակտերն այլ բան են փաստում:

Էջմիածնի շրջանի գյուղերից մեկում Ֆենյա Ս.-ն ապրում էր դստեր՝ Ծովիկի հետ (անունները փոխված են):

Երբ երեխան երկու տարեկան էր, Ֆենյայի ամուսինը հեռացավ ընտանիքից: Բայց Ֆենյայի տունն անտղամարդ չմնաց: Ֆենյայի տանը բնակություն հաստատեց նրա… տասը տարվա սիրեկանը: Ֆենյան Համլետ Գ.-ի հետ դեռ ամուսնությունից առաջ էլ կապված էր, ամուսնու հեռանալը նրան առանձնապես ցավ չպատճառեց:

Փոքրիկ Ծովիկի նկատմամբ Ֆենյան շատ խիստ էր՝ գոռում էր, ծեծում, իսկ Համլետին փայփայում էր, վախենում էր, որ Համլետը կարող է հոգնել իրենից, հատկապես՝ իր երեխայից, ու կարող է լքել, հեռանալ, իրեն թողնել անտղամարդ…

1982 թվականի օգոստոսին Ծովիկի 13 տարին բոլորեց: Նա արբունքի հասավ, հասունացավ: Մայրը ավելի խստացրեց դստեր նկատմամբ իր վերաբերմունքը:

Վերջին շրջանում Համլետը փոխվել էր, Ֆենյային առաջվա նման կարծես թե չէր սիրում, խոսք էր գցում հեռանալու մասին…

Եվ Ֆենյան Համլետին չկորցնելու համար որոշեց զոհողության գնալ: Նա զոհաբերեց հարազատ դստերը՝ ծեծեց Ծովիկին, քարշ տալով տարավ, գցեց անկողնում պառկած Համլետի գիրկը… Աղջկա թախանձանքն ու գոռոցները մոր գութը չշարժեցին:

Ծովիկի ներկայությամբ մայրը հաճախ էր Համլետի հետ անկողին մտել: Ծովիկը շատ բան էր տեսել, շատ բռնությունների էր դիմացել, բայց մոր ներկայությամբ ու մոր պարտադրանքով բռնաբարությունից հետո դեռահաս աղջիկը բոլորովին կորցրեց իրեն: Օրերով թափառում էր գյուղի շրջակայքում, երազում էր փախչել, բայց վախենում էր, գիշերները վերադառնում էր տուն, ծեծվում էր…

Մայրը որոշ ժամանակ Ծովիկին հանգիստ թողեց: Համլետի սիրտը շահել էր իր անօրինակ «սխրանքով», Համլետը նրան մի քանի ամիս սիրեց կարծես թե՝ առաջվա նման:

Բայց հետո նորից ֆենյան Համլետից սառնություն զգաց: Նորից հայացքն ուղղեց Ծովիկին: Աղջիկը մի տարով մեծացել, ավելի հասունացել էր…

1983 թվականի օգոստոսին Ֆենյան մի անգամ էլ դստերը «մատուցեց» Համլետին: Այս անգամ նա ավելի դաժան վարվեց, որովհետև աղջիկն ավելի կատաղի էր դիմադրում: Մայրը Ծովիկին ծեծեց, հատակին քարշ տալով հասցրեց մահճակալին, ձեռքերը կապեց մահճակալի ոտքից: Եվ հանձնեց Համլետի «տնօրինությանը»…

Այս բռնաբարությունից հետո Ծովիկը փախավ տանից: Նրան հարևաններից մեկը օթևան տվեց: Աղջիկը պատմեց , թե ինչ դժոխքի միջով է անցել: Հարևանների խորհրդով և աջակցությամբ Ծովիկը դիմեց իրավապահներին:

Հարուցվեց քրեական գործ: Նախաքննության ժամանակ պարզվեց, որ Ծովիկը ոչ միայն տանը՝ մոր սիրեկանի կողմից էր բռնաբարվել, այլև երկու անգամ բռնությունների էր ենթարկվել համագյուղացիների՝ Էդիկի ու Մամիկոնի կողմից, երբ տանից փախած՝ թափառել էր գյուղի շրջակայքում…

Անչափահաս աղջկա բռնաբարության չորս դրվագ հաստատվեց քրեական գործի քննությամբ:

Դատարանում 37-ամյա մայրը զղջման խոսքեր ասաց, նույնիսկ արտասվելու փորձ արեց: Տուժող աղջիկը մորը չներեց:

ՀԽՍՀ գերագույն դատարանի քրեական գործերով դատական կոլեգիան Ֆենյա Ս.-ին մեղավոր ճանաչեց այն ժամանակվա քրեական օրենսգրքի 112 հոդվածի 4-րդ մասով, 110 հոդվածով և դատապարտեց 12 տարի ազատազրկման: Ֆենյան 5 տարով զրկվեց ծնողական իրավունքից:

Ֆենյայի սիրեկան Համլետ Գ.-ն նույնպես դատապարտվեց 12 տարի ազատազրկման:

Անչափահաս աղջկա հետ սեռական հարաբերություններ ունենալու համար համագյուղացի Էդիկը դատապարտվեց 5 տարի, իսկ Մամիկոնը՝ 4 տարի ազատազրկման:
