Դատախազության կողմից բերված բողոքը հիմնավորված և պատճառաբանված չէ. Դավիթ Գրիգորյան

Գտնում եմ, որ առաջին ատյանի դատարանի կողմից կայացված որոշումն օրինական է, իսկ Դատախազության կողմից բերված բողոքը հիմնավորված և պատճառաբանված չէ. ենթակա է մերժման։ Այս մասին ՀՀ վերաքննիչ դատարանում ընթացող Երևանի ընդհանուր իրավասության դատարանի դատավոր Դավիթ Գրիգորյանի և նիստերի քարտուղար Գոռ Վարդանյանի վերաբերյալ քրեական գործի վարույթը կարճելու որոշման դեմ Դատախազության բողոքի քննության ընթացքում հայտարարեց Դավիթ Գրիգորյանը՝ նշելով, թե միայն երկու հարցի կանդրադառնա:

Նրա դիտարկմամբ՝ գործով մեղադրող դատախազը նախորդ նիստին նշել է, թե իրենք տեղյակ չեն եղել, որ քրեական գործը վարույթ է ընդունել դատավոր Դավիթ Բալայանը, սակայն, ըստ Գրիգորյանի, գլխավոր դատախազը դեռևս 2020թ. մայիսի 22-ին տեղյակ է եղել այդ մասին։

Գրիգորյանն անդրադարձավ նաև գործով մեղադրող դատախազի այն հայտարարությանը, թե իր երաշխիքները ապահովված են եղել՝ ասելով, թե դատախազը չնշեց, թե ի՞նչ երաշխիքներ։

«Ես կուզեի հարց տալ՝ ո՞ր երաշխիքների մասին է խոսքը։ Երևի իրենք նկատի ունեն, որ իմ աշխատասենյակում, իմ անձնական համակարգիչը առգրավելիս ինձ թույլ չեն տվել մասնակցել, իմ պաշտպան Գեորգի Մելիքյանին թույլ չեն տվել մասնակցել քննչական գործողությանը»։

Հիշեցնենք, որ հունիսի 5-ին դատավոր Դավիթ Բալայանը հանցակազմի բացակայության հիմքով որոշել էր Գրիգորյանի և Վարդանյանի նկատմամբ քրեական հետապնդումը դադարեցնել և գործի վարույթը կարճել:

Դավիթ Գրիգորյանին մեղադրանք էր առաջադրվել ՀՀ քրեական օրենսգրքի 314 հոդվածի 1-ին մասի հատկանիշներով՝ պաշտոնատար անձի կողմից շահադիտական նպատակով կամ անձնական այլ դրդումներով կամ խմբային շահերից ելնելով պաշտոնեական կեղծիք կատարելու համար։

Նշենք, որ Դավիթ Գրիգորյանը ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի գործով դատավորն էր և մայիսի 18-ին որոշում էր կայացրել Քոչարյանին ազատ արձակել՝ հիմք ընդունելով Արցախի ներկա և նախկին նախագահների անձնական երաշխավորությունը։
