Դատարանը մերժել է ֆուտբոլիստ Գոռ Մալաքյանին կալանավորելու՝ քննիչի միջնորդությունը․ պաշտպան

Երևանի ընդհանուր իրավասության դատարանը՝ դատավոր Դավիթ Հարությունյանի նախագահությամբ, մերժեց Հայաստանի ազգային հավաքականի կազմի ֆուտբոլիստ Գոռ Մալաքյանին կալանավորելու մասին քննիչի միջնորդությունը։ Այս մասին այսօր Tert.am-ը տեղեկացավ Մալաքյան եղբայրների պաշտպան Գոռ Միքայելյանից:

Փաստաբանը նշեց, որ դատարանը ոչ իրավաչափ է ճանաչել Գոռ Մալաքյանին ձերբակալելու մասին որոշումը՝ բավարարելով պաշտպանի բողոքը։

Նշենք, որ ավելի վաղ հայտնի էր դարձել, որ Մալաքյան եղբայրներից Էդգար Մալաքյանը կալանավորվել է մեկ ամսով դատավոր Հարություն Մանուկյանի որոշմամբ։ Դատարանը մասնակի բավարարել էր քննիչի միջնորդությունը, միևնույն ժամանակ ձերբակալությունը ճանաչել ոչ իրավաչափ։

Գոռ Միքայելյանը հայտեց, որ այս որոշման մասով պատրաստվում է բողոք ներկայացնել: Իսկ Գոռ Մալաքյանի մասով նշեց, որ դեռ որոշման ամբողջովին չի ծանոթացել և հավանական է, որ որոշման մեջ լինեն կետեր, որոնց առնչությամբ ևս բողոք ներկայացնելու կարիք կլինի:

Հիշեցնենք, որ համաձայն Քննաչական կոմիտեի հաղորդման՝ օգոստոսի 30-ին` ժամը 23:00-ի սահմաններում, 26-ամյա և 29-ամյա ֆուտբոլիստ եղբայրները, ընկերոջ և մի քանի այլ անձանց հետ գտնվել են Երևան քաղաքի «Կասկադ» համալրին հարող սրճարաններից մեկում: Նշված ժամանակահատվածում ՀՀ ճանապարհային ոստիկանության երկու տեսուչներ, ծառայություն իրականացնելիս, նկատել են կանգառ-կայանման կանոնները խախտած՝ եղբայրների ընկերոջը պատկանող «Մերսեդես» մակնիշի ավտոմեքենան և բարձրախոսով ներկայացրել մոտենալու պահանջ:

Վերջինիս տեղեկացնելով վարչական իրավախախման վերաբերյալ փաստը՝ կազմել են համապատասխան արձանագրություն: Այդ պահին նրանց են մոտեցել ոչ սթափ վիճակում գտնվող երկու եղբայրները, պահանջել տեսուչներից իրենց մարզիկ ընկերոջը պատասխանատվության չենթարկել, և մերժում ստանալով՝ դիտավորությամբ խոչընդոտել են ոստիկանների ծառայողական պարտականությունների իրականացմանը, քաշքշել նրանց, պոկել ոստիկաններից մեկի  ծառայողական կրծքանշանը և տեսագրիչ սարքը, մյուսի՝ ուսադիրը: 26-ամյա եղբայրը բռունցքով հարվածել է ոստիկաններից մեկի դեմքին և պատճառել մարմնական վնասվածք:
