Ոստիկանները փորձում էին տուգանել Փաստաբանների պալատի նախագահին դիմակ չկրելու համար, բայց վերջում իրենք իրենց տուգանեցին

Փաստաբանների պալատի նախագահ Արա Զոհրաբյանը ֆեյսբուքյան իր էջում գրել է՝

«ԴԻՄԱԿԱՀԱՆԴԵՍԻ ԳՈՐԾՈՎ

Անհրաժեշտ դեպքերում դիմակ կրելը համարել եմ կարևոր, անկախ պարետի որոշումից:

Այսօր Հյուսիսային պողոտայում ինձ մոտեցան 4 ոստիկան, և արձանագրություն կազմեցին, այն պատճառաբանությամբ, որ դիմակը չէր ծածկում քիթս և բերանս:

Ընդ որում, դիմակն այդպես էի կրում, քանի որ պարետի որոշմամբ սահմանված կանոնի համաձայն անհրաժեշտ է չհպվել դիմակին օգտագործման ժամանակ, հպվելու դեպքում ձեռքերը մշակել սպիրտ պարունակող միջոցով և լվանալ օճառով:
Հետևաբար, ըստ նույն կանոնի պետք է դիմակին դիպչեի միայն ախտահանման միջոց ունենալու դեպքում, քանի որ դիմակս խոսելու ընթացքում իջել էր:

Չէի անդրադառնա այս միջադեպին, եթե արձանագրություն կազմող ոստիկանները տիրապետեին ՀՀ վարչական իրավախախտման վերաբերյալ օրենսգրքի (ՎԻՎՕ) ընթացակարգային կանոններին, որոնց պարտավոր էին տիրապետել:

Սա մտահոգիչ եմ համարում մեծ թվով մեր քաղաքացիներին տուգանելու ֆոնին, քանի որ անիրազեկ քաղաքացին չի կարողանում իրեն պաշտպանել:

Ի խախտումն ՎԻՎՕ 225 հոդվածի չբացատրվեց իմ իրավունքները, որոնք նախատեսված են ՎԻՎՕ 267 հոդվածում:

Արձանագրության համապատասխան հատվածում, որտեղ նախատեսված է իրավունքներս բացատրելու մասին իրենց գործողության նկարագրությունը, ոստիկանները գաղափար չունեին թե ինչ պետք է բացատրեն ինձ:

Եվ վերջում ոտիկաններից մեկը հպվեց իր դիմակին և երբ պարզեցինք, որ նա խախտում է թույլ տվել, մյուս ոստիկանը (00993) հավաստիացրեց, որ արձանագրություն կկազմեն (այդ պահին վերջացել էին արձանագրության բլանկները):

Ոստիկանը պետք է այս դեպքում իմանա ընթացակարգային օրենսդրությունը և յուրաքանչյուր անգամ արձանագրություն կազմելիս պետք է հաշվի առնի գործի բոլոր հանգամանքները և ինքը չխախտի այն, ինչի համար տուգանում է մարդկանց:

Տուգանքի որոշում լինելու դեպքում այն վիճարկելու եմ»:
