33-ամյա տղամարդուն մեղադրանք է առաջադրվել՝ թմրանյութերի ապօրինի շրջանառության և ոստիկանի նկատմամբ բռնություն գործադրելու համար

ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչությունում իրականացված բազմակողմանի քննությամբ պարզվել են 33-ամյա տղամարդու կողմից խմբի կազմում թմրամիջոցների ապօրինի շրջանառությամբ զբաղվելու, ինչպես նաև ոստիկանության ծառայողի նկատմամբ բռնություն գործադրելու դեպքերի հանգամանքները։

Քննությամբ ձեռք բերված փաստական տվյալների համաձայն՝ Երևան քաղաքի 33-ամյա բնակիչը, նախնական համաձայնության գալով մի խումբ անձանց հետ, իրացնելու նպատակով, Վրաստանի քաղաքացու կողմից ապօրինի ձեռք բերված, իսկ մի մասը՝ տնայնագործական եղանակով պատրաստված առանձնապես խոշոր չափերով՝ ավելի քան 303,32 գրամ քաշով «Հաշիշ», 3,2827 գրամ քաշով «ՄԴՄԱ (մեթիլենդիօքսիմեթամֆետամին)» և 123.41 գրամ քաշով «Կոկաին» տեսակի թմրամիջոցները 2016թ. հունիսի 29-ին, Վրաստանի քաղաքացու  կողմից վարձակալած բնակարանից  ապօրինի փոխադրել և պահել է իր բնակարանում:

Բացի այդ, նույն օրը՝ ժամը 17:30-ի սահմաններում, Երևան քաղաքի Մանանդյան և Նիզամի փողոցների խաչմերուկում իր վարած «ԲՄՎ» մակնիշի ավտոմեքենայով ընկնելով ոստիկանների շրջափակման մեջ, 33-ամյա տղամարդն, անտեսելով ոստիկանների օրինական պահանջը` կանգնել և չվարել, չի ենթարկվել և իր վարած ավտոմեքենայով դիտավորությամբ հարվածել է իր մեքենան շրջափակած, քրեական հետախուզության բաժանմունքի օպեր-լիազորի վարած «Վազ 21122» մակնիշի ավտոմեքենային:

Վերջինս ճեղքել է շրջափակումը, որից հետո, շարունակելով անտեսել իր մեքենայի դիմաց կանգնած նույն բաժանմունքի ավագ օպեր-լիազորի նույնաբնույթ հրահանգները` ավտոմեքենան վարել և դիմային հատվածով դիտավորությամբ հարվածել է վերջինիս ձախ կողմին, որից հետո ավագ օպեր-լիազորը, բռնվելով 33-ամյա տղամարդու վարած ավտոմեքենայից, փորձել է կասեցնել նրա փախուստը, սակայն, վերջինս շարունակել է վարել, որի հետևանքով ոստիկանության ծառայողին պատճառվել են առողջության թեթև վնասի հատկանիշներ չպարունակող մարմնական վնասվածքներ:

Ձեռք բերված բավարար ապացույցների համակցությամբ՝ 33-ամյա տղամարդուն մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 266-րդ հոդվածի (թմրամիջոցների, հոգեմետ (հոգեներգործուն) նյութերի և դրանց պրեկուրսորների ապօրինի շրջանառությունն իրացնելու կամ պատրաստելու նպատակով կամ դրանց ապօրինի իրացնելը) 3-րդ մասի 2-րդ կետով և 316-րդ հոդվածի (իշխանության ներկայացուցչի նկատմամբ բռնություն գործադրելը) 1-ին մասով: Վերջինս կալանավորվել է:

Նրա մասով նախաքննությունն ավարտվել է, և քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել  դատարան:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
