ՍԴ բարեփոխումների հանձնաժողովի հրահրած բանավեճն առավելապես քաղաքական է՝ հաշվի առնելով իշխող քաղաքական ուժի նկրտումները՝ «հեղափոխությունը դատական իշխանություն հասցնելու» ուղղությամբ․ Ռուբեն Մելիքյան

Երեկ Սահմանադրական բարեփոխումների հանձնաժողովի որոշմամբ հրահրվեց «Գերագույն դատարա՞ն» թե՞ «ՍԴ+Վճռաբեկ» բանավեճը։ Այս մասին գրառում է կատարել «Իրավական ուղի» ՀԿ համահիմնադիր, իրավապաշտպան Ռուբեն Մելիքյանը։ Նա մասնավորապես նշել է․

«Քանի որ երեկ առիթ եմ ունեցել որոշ ասպեկտներով արտահայտվել այդ հարցի շուրջ, կցանկանայ ամբողջացնել մոտեցումներս՝ թեզիսների ձևով․

1) «Գերագույն դատարանի» անկեղծ կողմնակիցներ Հայաստանում եղել են, կան և կան, և դա բնական է։ Նրանց

հիմնական փաստարկն այն է, որ երկու բարձր դատարանը միշտ հանգեցնում է «դատական պատերազմների»՝ խլելով դատական իշխանության կենսական ռեսուրսը։

2) «Սահմանադրական դատարանի» անկեղծ կողմնակիցներ Հայաստանում միշտ եղել են, կան և կլինեն։ Նրանց հիմնական փաստարկն այն է, որ Սահմանադրական արդարադատությունն ունի կարևոր և ժամանակի ընթացքում է՛լ ավելի կարևորվող յուրահատկություն, ուստի այն ենթադրում է մասնագիտացվածություն և որպես դրա դրսևորում՝ ինստիցիոնալ առանձնացվածություն։ «Դատական պատերազմների» փաստարկին այս մոտեցման կողմնակիցները պատասխանում են, որ բարձր դատարաննների միջև որոշակի մրցակցությունը նպաստում է նրանց իրավաբանության որակի բարձրացմանը։

3) «Մեկ թե երկու» բանավեճը մեզանում մինչև վերջերս եղել է առավելապես մասնագիտական և ոչ քաղաքական։

Վերջին անգամ այն թեժացել է 2005 թվականի Սահմանադրական փոփոխություններին ընդառաջ։

4) Եվրոպական տարածաշրջանում «Մեկ թե երկու» երկընտրանքը լուծվում է առավելապես հօգուտ «երկուսի»։ Թեև կան բացառություններ, օրինակ՝ Էստոնիան։

5) Հանձնաժողովի հրահրած բանավեճը, թեև ունի մասնագիտական բաղադրատարր, սակայն առավելապես քաղաքական է՝ հաշվի առնելով իշխող քաղաքական ուժի նկրտումները դատարանների և հատկապես Սահմանադրական դատարանի նկատմամբ վերահսկողություն հաստատելու, իրենց խոսքով՝ «հեղափոխությունը դատական իշխանություն հասցնելու» ուղղությամբ։

6) Այն ինչ անում է «հեղափոխական» քաղաքական ուժը՝ Հանձնաժողովում իր մասնագետ և ոչ մասնագետ ներկայացուցիչների ձեռամբ (վերապահում՝ «կողմ» քվեարկածների մեջ կարող են լինել նաև գաղափարի անկեղծ կողմնակիցներ), նոր բան չէ։ Նույնն արեցին ֆրանսիական հեղափոխանները դեռ 18-րդ դարի վերջերին՝ ձգտելով վերահսկողություն հաստատել ֆրանսիայի դատարանների («պաղլեմանների») նկատմամբ։ Հենց այդ պատճառով էլ 1790թ․ ստեղծվեց «Կուղ դը Կասասյոնի»՝ Վճռաբեկ դատարանի ինստիտուտը։

7) «Մե՞կ, թե՞ երկու» բանավեճն ինչ-որ տեղ ինձ հիշեցնում է քրիստոնյա աշխարհը մոտ 15-16 դար առաջ ալեկոծած ու պառակտման հանգեցրած «Մե՞կ բնություն, թե երկու բնություն Բանին Մարմնացելոյ» բանավեճը։ Հիմա, դարերի հեռվից, բոլոր կողմերը ճանաչում են, որ երկու բանաձևերն էլ կարող էին ճշմարտացի լինել կամ չլինել։ Կարևորը այլ հանգամանքներ են։ Նույնը՝ դատարաններին է վերաբերում։ «Մեկը» կամ «երկուսը» չէ էականը։ Ու առհասարակ՝ շատ ու շատ էական հարցեր կան, որ աչքաթող են արվում՝ փոխարենը իրավաբանական հանրությանը ներքաշելով լայն առումով ամուլ մի բանավեճի մեջ։

8. Ու՞ր է այն հայեցակարգը, որը երեկ ձայների չնչին տարբերությամբ ընդունվել է։ Ինչու՞ մինչ այս պահը հրապարակված չէ»։
