Հրաժարվելու ենք ԱԺ-ի կայուն մեծամասնության մեխանիզմից. քննարկվում է ընտրական տարիքի շեմը 18-ից իջեցնելու հարցը. Դանիել Իոաննիսյանը՝ ընտրական համակարգի փոփոխությունների մասին

Ընտրական բարեփոխումների հանձնաժողովը փետրվարի վերջից նիստեր է գումարել: Միայն երկու հարց կա, որոնց վերաբերյալ ձևավորված դիրքորոշում կա, մնացածը դեռևս քննարկման փուլում են: Մի հարցն այն է, որ խորհրդարանական հանրապետություն ենք ունենալու, և երկրորդ՝ հրաժարվելու ենք կայուն մեծամասնության մեխանիզմից: Այս մասին ընտրական համակարգի փոփոխությունների վերաբերյալ քննարկման ընթացքում հայտարարեց Սահմանադրական բարեփոխումների մասնագիտական հանձնաժողովի անդամ Դանիել Իոաննիսյանը:

Նա նշեց, որ ընտրական իրավունքի և իշխանության ձևավորման հետ կապված մի շարք հարցեր կան, որոնք հանձնաժողովի օրակարգում են: «Դրանցից մեկը վերաբերում է ընտրելու իրավունքի տարիքին, հաջորդը՝ հանրապետության նախագահի ընտրության մեխանիզմին, մյուսը՝ հանրաքվեների մեխանիզմին»,-նշեց նա՝ հավելելով, որ վերջին բլոկը, որը բավականին կարևոր է, Կառավարության ձևավորումն է կայուն մեծամասնությունից հրաժարվելու դեպքում:

«Ներկայիս Սահմանադրությունն ու Ընտրական օրենսգիրքը ենթադրում են, որ ընտրությունների արդյունքում խորհրդարանն ունենալու է կայուն մեծամասնություն, ըստ այդմ՝ Կառավարության ձևավորման խնդիրներ չեն լինում: Այժմ քննարկման հարց է, թե եթե հրաժարվում ենք կայուն մեծամասնության երաշխավորումից, ինչպես է ձևավորվելու Կառավարությունը»,-նշեց Իոաննիսյանը:

Նրա տեղեկացմամբ՝ ընտրական տարիքի վերաբերյալ քննարկվում է երեք հնարավոր սցենար. «Առաջին՝ թողնվում է այնպես, ինչպես կա. այսինքն՝18 տարեկան, ես այդ սցենարի կողմնակիցը չեմ: Սցենարներից մյուսի համաձայն՝ տարիքն իջեցվում է 16 կամ 17 տարեկան, ըստ երրորդ սցենարի՝ ազատություն է տրվում օրենսդիր մարմնին, և վերջինս կարող է որոշել, թե որ ընտրություններում ինչ տարիքային շեմ սահմանի»:

Իոաննիսյանն ընդգծեց, որ Հայաստանի մասով պետք է մի քանի բան հաշվի առնել՝ ՀՀ-ում 16 տարեկանից քաղաքացուն տրվում է ընտանիք կազմելու, աշխատելու և հարկեր վճարելու, հավաքների մասնակցելու իրավունք, և այդ ամենով հանդերձ ինչո՞ւ քաղաքացին չպետք է ունենա ընտրությունների միջոցով իշխանության ձևավորմանը մասնակցելու իրավունք:

«Դեռ ոչ վաղ անցյալում՝ 2018-ի ապրիլին, հենց այդ տարիքային խմբի երիտասարդները փողոց փակելով անմիջապես մասնակցություն ունեցան իշխանության ձևավորմանը: Եթե իրենք դա կարող են անել փողոց փակելով, ինչո՞ւ չեն կարող անել քվեաթերթիկի վրա»,-ասաց նա:
