Իշխանություններն ստեղծում են ձեռքի գործիք, որը հերթական պատուհասն է դառնալու մեր իրավական համակարգի համար և բեռ` պետբյուջեի վրա. փաստաբանը՝ հակակոռուպցիոն դատարանի մասին

Հակակոռուպցիոն դատարանի ստեղծումը որևէ հիմնավորում չունի, որովհետև նախ՝ չկան այդքան կոռուպցիոն գործեր, և երկրորդ՝ չկա այդ գործերը քննելու հետ կապված որևէ խնդիր: Այս մասին Tert.am-ի հետ զրույցում ասաց փաստաբան Երվանդ Վարոսյանը՝ ընդգծելով, թե սա հերթական ծրագիրն է, որը հայկական չէ, Հայաստանում չի գրվել և մեծ հակահայկական, հակապետական ծրագրի մաս է կազմում:

«Ես չեմ հանդիպել մի դեպք, որ բացահայտված լինի ինչ-որ կոռուպցիոն դրսևորում, և դրա քննության վերաբերյալ ինչ-որ խնդիրներ առաջանան, ուստի չկա այդ դատարանի անհրաժեշտությունը: Կարծում եմ՝ այստեղ երկու միտում կա՝ առաջին հերթին սա Սորոսի տխրահռչակ հիմնադրամի ծրագրերից հերթականն է ՀՀ-ի գլխին, և երկրորդ՝ մի քանի դատավորի շատ ավելի հեշտ է կառավարել, հրահանգներ տալ, քան ամբողջ դատական համակարգին»,-նշեց Վարոսյանը՝ հավելելով, թե այն Հայաստան ներմուծվող հերթական ծրագիրն է, որի շուրջ տարբեր մարդիկ «ձեռքեր կտաքացնեն» և փող կաշխատեն:

Վարոսյանի խոսքով՝ ավելի նպատակահարմար ու արդյունավետ կլիներ, որ այն գումարները, որոնք ծախսվելու են հակակոռուպցիոն դատարանի ստեղծման համար, օգտագործվեին գործող դատարանների խնդիրները լուծելու համար:

«Ծախսերը, որոնք նախատեսվում են հակակոռուպցիոն դատարանի ստեղծման համար, կարելի էր ուղղել այս դատական համակարգին, ավելացնել դատավորների հաստիքները և նվազեցնել գործող դատարանների ծանրաբեռնվածությունը: Հակառակ դեպքում` սա հերթական բեռն է լինելու ՀՀ պետբյուջեի վրա: Այսօր մեր դատական համակարգում կան էական խնդիրներ: Օրինակ՝ կարելի էր տարբերակել, թե որ դատավորները կամ քանի տարվա աշխատանքային փորձ ունեցողները պետք է քննեն ծանր և առանձնապես ծանր հանցագործություններով գործերը: Կարծում եմ՝ սա շատ ավելի կարևոր խնդիր է: Եթե ծախսեր կան անելու, կարելի է այս ուղղությամբ մտածել: Սրանք են իրական խնդիրները, որ լուծման կարիք ունեն»,-ասաց Վարոսյանը:

Վերջինիս դիտարկմամբ՝ դատարաններն այսօրվա դրությամբ էլ են նորմալ կարողանում քննել ինչպես մյուս, այնպես էլ այս կոռուպցիոն բնույթի գործերը: «Սա հերթական իմիտացիան է. իշխանություններն ընտրազանգվածին փորձում են խաբել, թե ՀՀ-ում կոռուպցիայի դեմ պայքարում են, ինչ-որ բան է փոխվել: Ինչ-որ բան փոխվել է այն առումով, որ եթե դատական համակարգը նախկինում էլ քաղաքական իշխանության ճնշման տակ էր, ապա այսօր փորձ է արվում լիակատար վերահսկողության տակ դնել: Այս բոլոր գործընթացներն ուղղված են դրան»:

Ինչ վերաբերում է ստեղծվող դատարանի դատավորների անկախությանը՝ փաստաբանը նշեց, թե նրանց անկախ լինելն արդեն իսկ այսօր է հարցականի տակ: «Այս իշխանության գործելաոճը ինձ հնարավորություն չի տալիս հավատալ, թե իրենք ինչ-որ ազնիվ մղումներ ունեն: Ակնհայտ է, որ ստեղծում են ձեռքի սովորական գործիք, որը հերթական անգամ պատուհաս է դառնալու մեր իրավական համակարգի համար»,-ասաց Երվանդ Վարոսյանը:
