Ձերբակալվել են «օրենքով գող» և նրա կողմից ղեկավարվող խմբավորման մասնակիցը

ՀՀ գլխավոր դատախազության հասարակական անվտանգության դեմ ուղղված հանցագործությունների գործերով վարչության դատավարական ղեկավարման ներքո ՀՀ ոստիկանության քրեական ոստիկանության գլխավոր վարչության և ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչության ծառայողների կողմից ձեռնարկված ծավալուն օպերատիվ-հետախուզական միջոցառումների և քննչական անհետաձգելի գործողությունների, համակարգված և հետևողական աշխատանքի արդյունքում բացահայտվել է «օրենքով գողի»՝ քրեական աստիճանակարգության բարձրագույն կարգավիճակ ունեցող անձի և այսպես կոչված «զոն նայող» հանդիսացող և «քրեական հեղինակության»՝ քրեական աստիճանակարգության բարձրագույն կարգավիճակ ունեցող անձանց կողմից քրեական ենթամշակույթ կրող խմբավորում ղեկավարելու, տարբեր անձանց կողմից այդ խմբավորումներին մասնակցելու և «օրենքով գողի»՝ քրեական աստիճանակարգության բարձրագույն կարգավիճակ ունեցող անձին՝ իր անօրինական ազդեցությունն օգտագործելով մասնավոր խնդրին վերաբերող վեճը լուծելու համար քաղաքացու կողմից դիմելու դեպքեր:


Բացահայտված հանցագործությունների դեպքերի առթիվ ՀՀ ոստիկանության քրեական ոստիկանության գլխավոր վարչությունում 2020թ. օգոստոսի 10-ին հարուցված քրեական գործն ըստ քննչական ենթակայության ուղարկվել է ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչություն, որտեղ ստեղծված քննչական խմբի կողմից 2020թ. օգոստոսի 13-ին ՀՀ ոստիկանության ծառայողների հետ համատեղ ջանքերով կատարված խուզարկությունների արդյունքում հայտնաբերվել և ձերբակալվել են «օրենքով գողի»՝ քրեական աստիճանակարգության բարձրագույն կարգավիճակ ունեցող անձը և նրա կողմից ղեկավարվող խմբավորման մասնակիցը: Քննությամբ պարզվել է, որ մասնավոր, այն է՝ իրեն պարտք մնացած գումարը քրեակատարողական հիմնարկում պահվող անձից վերադարձնելու հարցը լուծելու համար քաղաքացին դիմել է «օրենքով գողի» ՝ քրեական աստիճանակարգության բարձրագույն կարգավիճակ ունեցող անձին, ով այդ վեճն իր անօրինական ազդեցությունն օգտագործելու միջոցով լուծելու համար համապատասխան հանձնարարություն է տվել իր կողմից ղեկավարվող՝ քրեական ենթամշակույթ կրող խմբավորման մասնակցին: Վերջինս «օրենքով գողի» հանձնարարությունը փոխանցել է քրեակատարողական հիմնարկում գտնվող, «քրեական հեղինակության»՝ քրեական աստիճանակարգության բարձրագույն կարգավիճակ ունեցող, այսպես կոչված «զոն նայողին», ով իր հերթին իր կողմից ղեկավարվող քրեական ենթամշակույթ կրող խմբավորման մասնակիցների ներգրավմամբ ստանձնել է վեճի լուծման վերաբերյալ «օրենքով գողի» հանձնարարության կատարումը՝ ձեռնարկելով դրան ուղղված կոնկրետ գործողություններ: Քրեական գործով նախաքննությունը շարունակվում է, կատարվում են անհրաժեշտ և համարժեք բոլոր գործողությունները խմբավորման մասնակիցների և դրան ներգրավված անձանց ամբողջական շրջանակը պարզելու ուղղությամբ:
