Հատուկ քննչական ծառայությունը և ՀՀ գլխավոր դատախազությունն այլևս դադարել են կատարել իրենց սահմանադրական գործառույթները.Արթուր Ղազինյան

«Մեկ Հայաստան» կուսակցության հիմնադիր նախագահ  Արթուր Ղազինյանը ֆեյսբուքյան իր էջում գրում է.

Հատուկ քննչական ծառայությունը փաստացի նույնացրեց քաղաքական էիֆորիան և անձի խիստ հուզական վիճակը՝ ազատելով հանցագործին քրեական պատասխանատվությունից։

Սակայն իրավական նիգիլիզմը սրանով չավարտվեց։ Քննիչները որոշեցին, միջին ծանրության մարմնական վնասվածք ստացած տուժողը պետք է ենթարկվի քրեական պատասխանատվության՝ էիֆորիային, անգիտակցությանն ու «ժողովրդի» կամքին հակադրվելու և «հոգեկան խիստ հուզմունքը» չհարգելու համար։

Հատուկ քննչական ծառայությունը և ՀՀ գլխավոր դատախազությունն այլևս դադարել են կատարել իրենց սահմանադրական գործառույթները, իրավունքի և օրինականության պաշտպանության փոխարեն ստանձնել են մեկ մարդու հոգեկան խիստ հուզված վիճակը պաշտպանելու առաքելությունը։

Այս վիճակը խիստ բնորոշ է ժողովրդի իշխանության իրավիճակին, որտեղ իրավունքի ընդհանուր սկզբունքները, բնական իրավունքներն ու իրավական կարգը ստորադասվում են ինքնահռչակ «ժողովրդի» ներքին վախերին և հոգեկան խիստ հուզված վիճակին։

Ավելի քան վստահ եմ, որ ՀՀ ՀՔԾ-ում և ՀՀ Դատախազությունում աշխատում եմ հիմնականում պրոֆեսիոնալ և բանիմաց իրավաբաններ, որոնք անկաշկանդ և ազատ վիճակում արդեն վաղուց միջնորդություն էին ներկայացրել ՀՀ ԱԺ՝ պատգամավորին անձեռնմխելիությունից զրկելու և քրեական հետապնդում հարուցելու նպատակով, սակայն գտնվելով աշխատանքային պատանդի վիճակում, կատարում են պատանդառուների բոլոր խելագար պահանջները։

Բացարձակ չեմ արդարացնում նրանց, հակառակը, կրկնակի և եռակի ավել մեղադրում եմ շանտաժի ենթարկվելու, իրենց մասնագիտական արժանապատվությունը ստորացնելու և խամաճիկի կերպարանք ստանալու համար։ Հայաստանի իրավական կարգին նրանց հասցված վնասը մի քանի անգամ ավելի մեծ է, քան փողոցային, տհաս և անգրագետ քաղաքական իշխանության հասցրած վնասը, քանի որ իշխանությունը գործում է իրենց՝ պրոֆեսիոնալների ձեռքերով։

Այս խամաճիկները, իրենց բնույթով և տեսակով, շատ նման են կոլաբորացիոնիստներին, որոնք հանուն աշխատավարձի և իրենց պաշտոնի պատրաստ են ծառայել զավթիչներին, գնալ ցանկացած ստորության իրենց մասնագիտության և պետության դեմ։

Հայաստանում օրինակարգ իշխանության հաստատումից հետո նոր իշխանությունների առաջին քայլը պետք է լինի պատանդի վիճակից ազատել բոլոր պրոֆեսիոնալներին և Հայաստանում ձևավորել իրավունքի և օրինականության տարածություն։
