«Չդիմելով ՍԴ՝ դուք ևս մասնակից կդառնաք իշխանության կողմից բեմադրված հերթական խայտառակությանը»

Արդարադատության նախկին նախարար Արփինե Հովհաննիսյանը իր ֆեյսբուքյան էջում գրել է.

«Եթե այն ինչ հրապարակվել է մամուլում սահմանադրական հեղաշրջման մասով, ապա՝

Հարգե՜լի խորհրդարանական ընդդիմություն,

Ձեզ եմ ներկայացնում Վենետիկի հանձնաժողովի այսօր հրապարակվելիք կարծիքի 60-րդ կետը, որտեղ բառացիորեն նշված է, մեջբերում եմ.

«Հայաստանի Սահմանադրության 168( 2) և 169(2)-րդ հոդվածները նախատեսում են սահմանադրական փոփոխությունների սահմանադրական վերանայումը (ստուգումը):168(2)-րդ հոդվածը, սահմանում է, որ Սահմանադրական դատարանը մինչև Սահմանադրության փոփոխությունների նախագծի ընդունումը որոշում է դրանց համապատասխանությունը Սահմանադրությանը: Նման վերանայման(ստուգման) ՊԱՐՏԱԴԻՐ բնույթը հստակորեն սահմանված է 169(2) հոդվածում, որի համաձայն Ազգային ժողովը 168(2) հոդվածով նախատեսված դեպքերում դիմում է (պետք է դիմի ) Սահմանադրության փոփոխության հարցով:»

Պետք է նշել, որ հաջորդիվ տեքստում (69) Հանձնաժողովը նշել, է, որ եթե Սահմանադրությունը, ինչպես օրինակ Հայաստանի Սահմանադրությունը, նախատեսում է նման ex ante (նախնական) վերնայման հնարավորություն, ապա նման կանոնը պետք է պահպանվի:

Հարգելի' պատգամավորներ,

Այլ կերպ ասած, եթե դուք չեք դիմում Սահմանադրական դատարան, ( ինչ խուճուճ ու ախմախ հիմնավորմամբ էլ դա լինի) ապա Ձեր արարքը համապատասխանում է ՀՀ քրեական օրենսգրքի իշխանության յուրացում և սահմանադրական կարգի տապալում հանցակազմերին:

Իշխանափոխությունից հետո տարբեր դրվագներով տարբեր մարդիկ բազմիցս տապալել են սահմանադրական կարգը, բայց նման հավաքական կերպով իշխանություն յուրացնելու և սահմանադրական կարգ տապալելու դեպք դեռևս չի եղել:

Անիրավության այսքան բարձր նշաձող երբևէ դեռևս չի սահմանվել:

Ավելին, առանց սահմանադրական վերահսկողության սահմանադրական փոփոխությունները միանգամից ապալեգիտիմացնում է նաև հետագայում ընտրվելիք ՍԴ դատավորներին:
