Քոչարյանի պաշտանները հույս ունեն, որ ՍԴ-ն վարույթ կընդունի մյուս երկու դիմումները

ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի պաշտպանները հնարավոր է լրամշակեն եւ կրկին ՍԴ ներկայացնեն ՀՀ քրեական դատավարության օրենսգրքի 414․2-րդ հոդվածի 1-ին մասի 1-ին կետի Սահմանադրությանը համապատասխանության հարցը որոշելու վերաբերյալ դիմումը: Այս մասին այսօր՝ հունվարի 31-ին Վերաքննիչ քրեական դատարանում լրագրողների հետ զրույցում ասաց Քոչարյանի փաստաբանական թիմի անդամ Արամ Օրբելյանը:

Նա հույս հայտնեց, որ Սահմանադրական դատարանը վարույթ կընդունի եւ քննի մյուս երկու բողոքները:

Նա ասաց, որ ՍԴ աշխատանքային որոշումից հասկացել են, որ եթե Քոչարյանի անձեռնմխելիության հարցով դիմեն, ՍԴ-ն այդ դիմումը վարույթ կընդունի:

Հիշեցնենք, որ Սահմանադրական դատարանի հունվարի 25-ի որոշմամբ մերժվել է Ռոբերտ Քոչարյանի դիմումի հիման վրա քրեական դատավարության օրենսգրքի 414․2-րդ հոդվածի 1-ին մասի 1-ին կետի Սահմանադրությանը համապատասխանության հարցը որոշելու վերաբերյալ գործի քննությունը:

Սահմանադրական դատարանի կողմից ընդունված ծավալուն որոշմամբ շեշտվել է, որ Սահմանադրության մեկնաբանության հարցերին վերջնական լուծում տալու լիազորությունը վերապահված է միայն Սահմանադրական դատարանին: Համանման պնդում ներկայացվել էր հենց դիմումի մեջ: Դատարանը նաեւ ընդգծել է, որ բոլոր դատարանները, այլ ոչ միայն Վճռաբեկ դատարանը, պետք է ինցիդենտ կերպով ստուգեն կիրառվելիք նորմատիվ իրավական ակտի սահմանադրականությունը եւ պարտավոր են դիմել Սահմանադրական դատարան՝ համապատասխան հիմքերի առկայության դեպքում:

Հիշեցնենք, որ Ռոբերտ Քոչարյանի փաստաբանական թիմի կողմից ՀՀ սահմանադրական դատարան ներկայացվել էին երեք դիմումներ:
