Ի՞նչ մասնակցություն է ունեցել բանակն ու անձամբ Սեյրան Օհանյանը Մարտի 1-ին. փաստեր (Տեսանյութ)

Պաշտպանության նախկին նախարար Սեյրան Օհանյանը, ով մարտի մեկի ողբերգական իրադարձությունների ժամանակ զբաղեցնում էր Զինված ուժերի գլխավոր շտաբի պետի պաշտոնը, այժմ հայտնվելով ընդդիմադիր ճամբարում՝ խոստանում է բացահայտել Մարտի 1-ը, իսկ ավելի վաղ հերքել էր բանակի ներգրավվածությունը մարտի 1-ի իրադարձություններին. «Զինված ուժերը ոչ մի դերակատարություն չեն ունեցել: Մարտի 2-ից նրանք անցել են Հայաստանի Հանրապետության մայրաքաղաքի կարևոր օբյեկտների պաշտպանությանը, և այնտեղ հստակ երևում է, որ ես խնդրել եմ մեր ժողովրդին պաշտպանել հանդուրժողականություն»,- հայտարարել է Օհանյանը։
Սակայն այն, որ բանակն, այնուամենայնիվ, ունեցել է ակտիվ դերակատարություն, վկայում են «Փաստահավաք» խմբի անդամներ Անդրանիկ Քոչարյանի և Սեդա Սաֆարյանի զեկույցները։

«Բանակի ներգրավումն ու մասնակցությունը հետընտրական գործընթացներին և մարտի 1-2-ի իրադարձություններին» վերնագրով զեկույցում Ս. Սաֆարյանն ու Ա. Քոչարյանը նշում են՝ 2008թ. մարտի 1-ին ՀՀ նախագահ Ռ. Քոչարյանը հրամանագիր է ստորագրել Երևան քաղաքում 20 օր ժամկետով «Արտակարգ դրություն հայտարարելու մասին»։ Նույն հրամանագրի 3-րդ կետով արտակարգ դրության իրավական ռեժիմի ապահովումը վերապահվել է ՀՀ Ոստիկանությանն ու ՀՀ Պաշտպանության նախարարությանը: Որպեսզի ակնհայտ դառնա այն իրողությունը, որ արտակարգ դրության իրավական ռեժիմի ապահովումը պաշտպանության նախարարությանը վերապահելով՝ ներգրավվել են ՀՀ Զինված ուժերը, վկայակոչենք 2008թ. մարտի 1-ի դրությամբ գործող Պաշտպանության մասին ՀՀ օրենքի 9-րդ հոդվածի 3-րդ մասը: Զինված ուժերը ներառում են պաշտպանության նախարարության զորամասերի, զորախմբերի, զորամիավորումների, զինվորական կառավարման մարմինների, ձեռնարկությունների, հիմնարկների ու կազմակերպությունների, ռազմաուսումնական հաստատությունների ամբողջական համակարգը: Վկայակոչված օրենքի դրույթը լիովին բավարար է՝ եզրակացնելու համար, որ արտակարգ դրության իրավական ռեժիմի ապահովումը ՀՀ պաշտպանության նախարարությանը վերապահելը նույնական է զինված ուժերին վերապահմանը: Իսկ «զինված ուժեր» ասվածը բանակն է»,- նշված է զեկույցում։

Նշվում է նաև, որ նախագահ Ռ. Քոչարյանը արտակարգ դրություն հայտարարելու մասին 01.03.2008թ. հրամանագրով աներկբա դուրս է եկել Սահմանադրությամբ իրեն վերապահված լիազորությունների շրջանակներից, կատարել է գործողություններ, որոնց համար լիազորված չի եղել ոչ Սահմանադրությամբ, ոչ էլ օրենքներով. «Արտակարգ դրություն հայտարարելու մասին հրամանագրով Երևան քաղաքում մտցրել է ռազմական դրությանը հատուկ սահմանափակումներ, բանակը ներգրավել է ներքաղաքական գործընթացներում, կատարել է իշխանազանցություն, ինչը հանգեցրել է ծանր հետևանքների՝ առնվազն 10 մարդ է սպանվել, հարյուրավորները վիրավորվել են, ՀՀ քաղաքացիներին, կազմակերպություններին ու պետությանը պատճառվել է միլիոնավոր դրամների վնաս, ճնշվել ու խափանվել են հազարավոր ՀՀ քաղաքացիների Սահմանադրական իրավունքների ու ազատությունների խաղաղ իրականացումը»:
