Պարվիրված օրինախախտումները մեր նոր դատաիրավական համակարգում այլևս պետք է բացառվեն

Արդեն գրեթ երկու ամիս է, ինչ շարունակվում է արծարծվել Գագիկ Ծառուկյանի թիկնազորի պետ Էդուարդ Բաբայանի կալանավորման և այս գործի հետ կապված մութ պատմության հարցը: Այս առթիվ ենթադրյալ տուժող Վյաչեսլավ Հարությունովը, էլ լրատվամիջոց չմնաց, որ հարցազրույց չտա և չպատմի ողջ եղելությունը, նույն բաները պատմելով նաև գործի առթիվ տեղի ունեցած հարցաքննությունների ժամանակ: Սակայն պարզվում է, որ այս գործով զբաղվող իրավապահ մարմինների մեջ եղել են աշխատակիցներ, ովքեր շահագրգռված են եղել այն հարցում, որ Հարությունովը բոլորովին այլ ցուցմունքներ տա՝ ընդհուպ մինչև սպառնացել են վերջինիս որոշակի տեսանյութերի գոյությամբ ու դրանց հրապարակման հետևանքներով:

Պարզվում է, որ այս քրգործի ամենամեծ կեղծիքը սկսվում է դատաբժշկի կողմից տրված եզրակացությունից: Բանն այն է, որ ըստ եզրակացության Վյաչեսլավ Հարությունովին հասցվել է ծանր առողջական վնաս, ուղեղի ցնցում, կողոսկրի կոտրվածք, ծակվել է թոքը, միչդեռ փաստերը լրիվ այլ բան են վկայում: Քանզի ենթադրյալ տուժողը պարզապես չէր կարող ըստ տրված եզրակացության դուրս գրվեր հիվանդանոցից ընդամենը երկու օր հետո, առանց որևէ վիրահատական միջամտության, առավել ևս դուրս գրվելուց անմիջապես հետո ժամերով սպասել դատարանի առջև, բարձրաձայն խոսել, ակտիվ շարժվել՝ ձեռքերը ազատ և անկաշկանդ վերև-ներքև անելով:

Փաստորեն դատաբժշկական եզրակացությունը կեղծ էր, հետևաբար այս ամենը սկսվել ու շարունակվում է հենց կեղծիքով: Ու այս ընթացքում խախտվում են ոչ միայն մեղադրյալ կողմի իրավունքները՝ նրան անազատության մեջ անհիմն ու կեղծված փաստերի հիմնավորումով պահելով, այլև տուժող կողմ համարվող Հարությունովի իրավունքները՝ նրան անընդհատ հետապնդելով, նրա խոսքն ու ցուցմունքերը հաշվի չառնելով:

Հետևավաբար սա մի հին ձեռագիր է, որը կիրառվել է առաջ, բայց որը տեղ չունի նոր Հայաստանում: Կարելի է միանալ Հարությունովի հորդորին ու դիմել ՀՀ վարչապետ Նիկոլ Փաշինյանին, որպեսզի նման երևույթներին հատուկ ուշադրության արժանացնի, որպեսզի նման օրինախախտները հասկանան, որ իրենց պատվիրատուների հին մեթոդները մեր դատաիրավական համակարգում այլևս տեղ չունեն:
