Նոր Հայաստանում գործում է հին դատական համակարգը

Թեհմինե Մազմանյանն իր ֆեյսբուքյան էջում գրում է.

Այսօր երևաց, որ նոր Հայաստանում դատական համակարգը դեռ պետք է անկախացման երկար ճանապարհ անցնի, քանի որ կան դեպքեր, երբ դատարանը կայացնում է չհիմնավորված վճիռներ, առաջնորդվում երկակի ստանդարտներով: 

 

Այսօր դատարանը մերժեց ազատ արձակել Գագիկ Ծառուկյանի օգնական Էդուարդ Բաբայանին, այն դեպքում, երբ դրա համար կային բոլոր իրավական հիմքերը: Հիշեցնենք, որ նա կալանավորվել է Վյաչեսլավ Հարությունովին ծեծի ենթարկելու մեղադրանքով, այն դեպքւոմ, երբ չկա ցուցմունք, չկա դատաբժշկական փորձքաննության արդյունք, իսկ ինքը՝ Հարությունովը բազմիցս նշել է, որ ծեծի չի ենթարկվել Բաբայանի կողմից:

Ենթադրյալ տուժողը իր սկզբանական ցուցումքները ներկայացրել է պրոմեդոլ դեղի ազդեցության տակ, որը առաջացնում է գիտակցության մթագնում և հալյուցինացիաներ, ապա դեղի ազդեցությունը թողնելուց հետո հերքել է իր իսկ ցուցմունքները: Այսինքն փաստացի գործով տուժող որպես այդպիսին չկա: Ավելին, անգամ ՀՔԾ-ն առայսօր չի հարցաքննել Բաբայանին, չնայած նրա փաստաբանները բազմիցս միջնորդություն են ներկայացրել հարցաքննության համար: 

Ինչևէ, այդքանից հետո այսօր դատարանը մերժեց 50 միլիոն գրավի դիմաց Բաբայանին ազատ արձակելու՝ փաստաբանի միջնորդությունը: Բավական է միայն հիշեցնել, թե վերջին ժամանակներս հանրությանը հայտնի ինչպիսի դեմքեր գրավի դիմաց ազատ արձակվեցին, ու դեռ արձակվելու են, ու ինչպիսի հոդվածներով էին նրանք կալանավորվել:

Միթե՞ սա երկակի ստանդարտների կիրառում չէ դատարանի կողմից: Մի կողմից ազատ են արձակվում աղմկոտ դեպքերով անձնող անձինք, իսկ մյուս կողմից դատարանը մերժում է ազատ արձակել մեկին, ով առանց որևէ իրավական հիմքերի է կալանքի տակ:

Ինչևէ ամփոփելով ասենք, որ անկախ դատական համակարգը դեռ հեռու է այդպիսին լինելուց, դատարանը որոշ դեպքերում ցուցաբերում է ակնհայտ ուղղորդված գործունեություն և ընդհանրապես արդարադատությունը նոր Հայաստանում դեռ պետք է երկար ճանապարհ անցնի դեպի կայացումը:
