Միթե դատական համակարգը քաղաքական շահերի լուծման համար գործիք է մնալու․․․․

Մովսես Վարդանյանը ֆեյսբուքյան իր էջում գրում է.

Նոր Հայաստան, նոր գաղափարաբանություն և նոր արժեհամակարգ։ Ահա այն ամենը ինչի ակնկալիքը ունենք բոլորս հեղափոխութոյւնից հետո՝ որպես արդյունք տեսնել։ Սակայն որքանով են մեր սպասելիքները արդարանալու, դեռ պարզ չէ։ Ավելին՝ արդեն որոշակի միտումներ են նկատվում, որ Դատական համակարգում կարծես թե շարունակվում է ավանդական կիրառվող կախվածության մշակույթը։

Այն է, թե վճիռը կլինի այնպես, ինչպես կասեն վերևից։ Ու մինչ թվում էր, թե հեղափոխությունից հետո Հայաստանում այլևս չի գործելու այս հակաիրավական ձևաչափը որպես դատական համակարգի գործելաոճ, բայց արի ու տես, որ սպասելիքները չարդարացան։ Հուլիսի 3-ին ձերբալա;վել էր ՀԱՕԿ նախագահ Գագիկ Ծառուկյանի օգնական Էդուարդ Բաբայանը։ Առանց իրավական հիմքերի իրականացված մեղադրանքը չի կարող ձերբակալման համար առիթ հանդիսանալ,ինչպես նաև չի կարող մի քանի փաստարկներ քննարկվող դատական նիստև տևել վեց ժամ։ Եթե այստեղ իհարկե այլ շարժառիթներ չկան։

Հսատկանշական է, որ առկա բոլոր փաստարկները խոսում են այն մասին, որ Էդուարդ Բաբայանը ժամ առաջ պետք է գտնվի ազատության մեջ, քանի որ ոչ միայն Օլիմպավանում միջադեպ չի եղել, ոչ միայն Վ․Հարությունովի հիվանդանոցում հայտնվելու հանգամանքը նրա հետ կապ չունի, այլև Բաբայանի դեմ բողոք չկա։ Հետևաբար ինչպե՞ս կարող է դատարանը անմեղ մարդուն ՝ փաստերի ի սպառ բացակայության պարագայում պահել անազատության մեջ։

Ու կայացնել վճիռ, որ բողոքի հայտը մերժվում է։ Էլ ինչո՞ւ էին այդքան երկարաձգում նիստը․ միթե սպասում էին անգո փաստերի հայթայթման, թե դարտարաին կամքի թելադրման հերթական դեպքին․․․

Ցավալի է, բայց այս դեպքը ցույց է տալիս, որ մեզանում դատական համակարգը շարունակում է գնալ նախկին որդեգրած ճանապարհով, նույն դիմագիծը, նուն գործելաոճը։ Հետևաբար, եթե քաաքական շահը նորից շարունակվում է լուծվել դատական համակարգը գործիք դարձնելով, ուրեմն այս պայքարն ու նոր Հայաստանի մեր տեսլականը երբեք էլ իրապես չի կայանա։
