Դատական համակարգը այնքան անկախ չէ, ինչքան ասվում է կամ ներկայացվում

Սարգիս Հովսեփյանը ֆեյսբուքյան իր էջում գրում է.

Թվում էր, թե հեղափոխությունից հետո Հայաստանում այլևս բացառվելու են ոչ իրավաչափ ձերբակալությունները, սակայն պարզվեց որ դա այդպես չէ։ Այսպես, ՀԱՕԿ նախագահ Գագիկ Ծառուկյանի օգնական Էդուարդ Բաբայանը երեկ ձերբակալվել է առանց իրավական հիմքերի, ոմն Հարությունովի հնչեցրած մեղադրանքների հիման վրա։

Վերջինս հայտարարել է, որ ենթարկվել է ծեծի, իսկ հետո հերքել է իր իսկ ասածները ու նշել, որ ոչ մի բողոք չունի։ Նրա կինը նշել է , որ ամուսինը իր մեղադրանքները հնչեցրել է ոչ սթափ դատողության պայմաններում։ Չկա նաև Հարությունովի ստացած վնասվածքների մասին դատաբժշկական փորձաքննության արդյունք, որը կարող էր հիմք հանդիսանալ ձերբակալության համար։

Թվում էր, թե այսքանից հետո Երևանի առաջին իրավասության դատարանը պետք է անմիջապես ազատ արձակեր Էդուարդ Բաբայանին ոչ իրավաչափ ձերբակալությունից, սակայն՝ ոչ։ Ավելին, դատարանի քննարկումը, որը նման դեպքերում սովորաբար տևում է 1 ժամից ոչ ավել, այս անգամ տևել է ավելի քան 7 ժամ, ինչը հստակ ցույց է տվել, որ դատարանում Էդուարդ Բաբայանի դեպքում սպասել են ինչ-որ ցուցումի։ Փաստորեն դատարանը Էդուարդ Բաբայանին ազատ չարձակեց, այն դեպքւոմ, երբ չկա բողոք, չկա դատաբժշկական փորձաքննության արդյունքներ։

Այսպիսով պարզ է դառնում, որ դատական համակարգը Հայաստանում այնքան էլ անկախ չէ, ինչքան ասվում է կամ ներկայացվում, քանի որ այս պահին ոչ իրավաչափ կերպով անձին պահում են կալանքի տակ և մերժում նրան ազատ արձակելու բողոքը։ Հստակ է նաև, որ այս իրավական գործողությունները իրենց հիմքում ունեն հստակ քաղաքական դրդապատճառներ։
