Փոփոխություններ «Դեղերի մասին» օրենքում. առաքման, դեղապահովման հարցեր. «Փաստ»

«Փաստ» օրաթերթը գրում է.

«Դեղերի մասին» օրենքում փոփոխություններ են մտցվել: Նոր նախագիծ է մշակվել, որը նպատակ ունի կարգավորել դեղատնից դեղերի առաքման հետ կապված հարաբերությունները:

Մասնավորապես, ակնկալվում է դեղերի առաքմանը ներկայացվող տեխնիկական և մասնագիտական պահանջների սահմանման միջոցով կարգավորել և պատշաճ կարգով կազմակերպել առողջական խնդիրներ ունեցող պացիենտների՝ հենաշարժողական խնդիրներ ունեցող քաղաքացիների, միայնակ ծերերի դեղապահովումը: Նախագծի ընդունման նպատակն է նաև դեղերի հասանելիությունը և մատչելիությունը:

Դեղատնային գործունեության լիցենզիա ունեցող իրավաբանական անձինք կամ անհատ ձեռնարկատերերը կարող են իրականացնել դեղերի առաքում օրենսդրությամբ սահմանված դեղերի առաքմանը ներկայացվող տեխնիկական և մասնագիտական պահանջներին համապատասխան:

Առաջարկվող նախագծով նախատեսվում է սահմանել առաքմանը ներկայացվող տեխնիկական և մասնագիտական պահանջները:

Նախագիծը մշակվել է ՀՀ առողջապահության նախարարության դեղորայքային քաղաքականության և բժշկական տեխնոլոգիաների վարչության և «Ակադեմիկոս Էմիլ Գաբրիելյանի անվան դեղերի և բժշկական տեխնոլոգիաների փորձագիտական կենտրոն» ՓԲԸ–ի կողմից:

Նախագծով սահմանվել են հետևյալ կարգավորումները:

Առաքումն իրականացնելու նպատակով դեղատանը վարվում է առաքումների գրանցման մատյան, որը ներառում է դեղի պատվերի ընդունման և առաքման վերաբերյալ տվյալներ: Առաքման պատվերը ընդունվում է հեռախոսային կապի միջոցով կամ էլեկտրոնային եղանակով:

Պատվերի ընդունման ժամանակ առաքումների գրանցման մատյանում լրացվում են դեղի անվանումը, դեղաչափը, դեղաձևը, քանակը, պատվիրատուի անունը, ազգանունը, առաքման հասցեն, պատվերի ստացման ամսաթիվը: Առաքումն իրականացվում է պատվերը գրանցելուց հետո առավելագույնը 48 ժամվա ընթացքում, առաքման ժամը համաձայնեցնելով պատվիրատուի հետ:

Նախագծում նշված է, որ պատվիրատուն նախքան առաքումը անպայման տեղեկացվում է առաքվող դեղի և ծառայության արժեքի մասին:

Նոր կագավորումների համաձայն, սակայն, ոչ բոլոր դեպքերում է հնարավոր դեղերի առաքման տարբերակից օգտվել: Այսպես, դեղատոմսով բաց թողնվող դեղերի առաքման պատվերն ընդունվում է միայն էլեկտրոնային դեղատոմսի կամ դեղատոմսի պատճենի առկայության դեպքում:

Պատվերը գրանցելուց հետո դեղագետը կամ դեղագործը պատվիրատուին է տրամադրում անհրաժեշտ տեղեկատվություն՝ դեղատանը առկա նույն բաղադրատարրը պարունակող, նույն դեղաչափով և դեղաձևով փոխադարձաբար փոխարինելի բոլոր դեղերի վերաբերյալ, այդ թվում՝ գների մասին՝ առանց ուղղորդման:

Պատվիրատուի հետ համաձայնեցնելուց հետո առաքումների գրանցման մատյանում լրացվում են առաքվող դեղի առևտրային անվանումը, սերիան, պիտանիության ժամկետը: Ի դեպ, թմրամիջոցներ և հոգեմետ նյութեր պարունակող դեղերի առաքումը արգելվում է:

Դեղերի առաքումը պատվիրատուին իրականացվում է ապահովելով դեղի գրանցման ժամանակ հաստատված պահման և տեղափոխման պայմանների համապատասխանությունը: Դեղատոմսով բաց թողնվող դեղի առաքումն իրականացվում է դեղագետի կամ դեղագործի կողմից: Առաքողը պատվիրատուին տրամադրում է դեղի կիրառման վերաբերյալ անհրաժեշտ տեղեկատվություն:

Դեղի ստացման փաստը հաստատվում է առաքողի կողմից ներկայացված փաստաթղթի վրա` պատվիրատուի ստորագրությամբ՝ նշելով ամսաթիվը և ստացման ժամը:

Առաքման ծառայության, ինչպես նաև դեղի արժեքի վճարումը իրականացվում է օրենսդրության համապատասխան` պատվիրատուի և դեղատան փոխպայմանավորվածության համաձայն: Միաժամանակ, ինչպես և դեղատնից գնելու դեպքում, այնպես էլ այս՝ առաքված դեղը վերադարձման ենթակա չէ:
