Գործարքի վավերության համար կնիքի առկայությունն այլևս պարտադիր չէ. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Արդարադատության նախարարության կողմից մշակվել է մի նախագիծ, որն էականորեն կթեթևացնի իրավաբանական անձ հանդիսացող քաղաքացիների գործունեությունը: Բանն այն է, որ նոր նախագծով առաջարկվել է գործարքի վավերությունը չկապել կնիքով դրոշմված չլինելու հանգամանքի հետ, ինչպես նաև բացառել իրավաբանական անձի կողմից կնիքի կիրառման անհրաժեշտությունը:

«Գործարարությամբ զբաղվելը 2018» ծրագրի վարկանիշային աղյուսակի «Ընկերությունների գրանցումը» ցուցիչով ՀՀ զբաղեցրած դիրքի համար հիմք է հանդիսացել նաև օրենսդրության մեջ իրավաբանական անձանց համար կնիք ունենալու և կնիքի կիրառման պահանջ սահմանող դրույթների առկայությունը:

ՀՀ քաղաքացիական, վարչական դատավարության և հարկային օրենսգրքերում, ինչպես նաև «Փողերի լվացման և ահաբեկչության ֆինանսավորման դեմ պայքարի մասին» օրենքում առկա են կնիքի կիրառելիության վերաբերյալ դրույթներ, որոնք խնդրահարույց են վերոնշյալ տեսանկյունից:

Նախագիծը մշակվել է ՀՀ արդարադատության նախարարության «Օրենսդրության զարգացման և իրավական հետազոտությունների կենտրոն» հիմնադրամի կողմից, որի ընդունման արդյունքում կբացառվի կնիքի կիրառման անհրաժեշտությունը:

Նախագիծը կառավարության Իրավական ակտերի նախագծերի հրապարակման միասնական կայքում շրջանառության է դրվել երեկ, և մինչև ապրիլի 25–ը հանրությունը կկարողանա քվեարկել այս նախագծին կամ առաջարկով հանդես գալ:

Նշենք, որ նախագծի համաձայն՝ փոփոխության կենթարկվի քաղաքացիական օրենսգրքի 296–րդ հոդվածի 2–րդ մասը, որտեղ առաջին նախադասության մեջ կհանվեն «կնիքով դրոշմված լինելը» բառերը: Փոխարենը նախադասությունը կլրացվի հետևյալ բովանդակությամբ. «Գործարքի՝ կնիքով դրոշմված չլինելը չի հանգեցնում այդ գործարքի անվավերության»:
