«Խոր Վիրապ» վանական համալիրի մոտ խաբել է չինուհուն , նստեցրել ավտոմեքենան եւ փորձել բռնաբարել

Սեքսուալ բնույթի բռնի գործողություններ կատարելու մեջ մեղադրվող Արարատի մարզի 33-ամյա բնակիչը մեղավոր է ճանաչվել ՀՀ քրեական օրենսգրքի 139-րդ հոդվածի 1-ին մասով դատապարտվելով 3 տարի 3 ամիս ժամկետով ազատազրկման:

Ըստ մեղադրանքի՝ Խաչիկը 2017 թվականի հոկտեմբերի 1-ին՝ ժամը 19.00-ի սահմաններում, Արարատի մարզի Ուրցաձոր գյուղի վարչական տարածքում գտնվող Վայրի կենդանիների փրկարար կենտրոն կոչվող վայրում Չինաստանի Ժողովրդական Հանրապետության քաղաքացուհու կամքին հակառակ և նրա նկատմամբ բռնություն գործադրելով՝ կատարել է սեքսուալ բնույթի բռնի գործողություններ:

Նշված օրը ժամը 16.00-ի սահմաններում, Խաչիկը իր վարած «Վազ 2106» մակնիշի ավտոմեքենայով Արարատի մարզի Փոքր Վեդի գյուղում գտնվող «Խոր Վիրապ» վանական համալիրի մոտակայքում՝ կենտրոնական ճանապարհին, նկատել է մինչ այդ իրեն անծանոթ՝ չինուհուն և ժեստերով հաղորդակցվելով՝ հասկացել է, որ նա ցանկանում է գնալ Երևան, որից հետո առաջարկել է նրան նստել իր ավտոմեքենան: Սակայն Երևան գնալու փոխարեն ավտոմեքենան վարել է Արարատ քաղաքի ուղղությամբ, նրան ցուցադրել է մի քանի տեսարժան վայրեր և շրջելով՝ միասին գնացել են Ուրցաձոր գյուղում գտնվող «Վայրի կենդանիների փրկարար կենտրոն» կոչվող տարածք, որտեղ Խաչիկը ցանկանալով սեռական հարաբերություն ունենալ չինուհու հետ, գրկել է նրան, գցել գետնին, փորձել է պառկել նրա վրա, սակայն վերջինս դիմադրել է ու կծել Խաչիկի այտը և կրծքավանդակի ձախ հատվածը:

Աղջիկը նրան հասկացրել է, որ կույս է, ինչից հետո Խաչիկը հրաժարվելով սեռական հարաբերություն ունենալու մտքից՝ սեռական կրքերին խաթարված ձևով հագուրդ տալու նպատակով չինուհու կամքին հակառակ և վերջինիս նկատմամբ բռնություն գործադրելով՝ կծել է նրա զույգ այտերը, ձեռքերով հարվածներ է հասցրել նրա գլխին և մարմնի տարբեր հատվածներին:

Այդ ամենից հետո սեքսուալ բնույթի բռնի գործողություններ է կատարել, և չինուհին վախենալով, որ Խաչիկը կարող է իրեն վնասել, կատարել է նրա պահանջը: Սակայն այդ ընթացքում նկատելով իրենց ուղղությամբ շարժվող ավտոմեքենան՝ ընդառաջ է վազել այդ ավտոմեքենային և առանց ավտոմեքենայի վարորդի և նրա ուղևորի թույլտվության և նրանց հետ առանց որևէ խոսք փոխանակելու՝ նստել է նրանց ավտոմեքենան, ապա հեռացել նշված վայրից:

Քրեական գործը քննվել է արագացված ընթացակարգով՝ մինչ դատաքննությունն սկսելն ամբաստանյալը միջնորդել է դատական քննությունն անցկացնել արագացված կարգով և հայտարարել, որ առաջադրված մեղադրանքում իրեն մեղավոր է ճանաչում լիովին և զղջում է կատարածի համար:

Նշենք, որ Խաչիկի նկատմամբ որպես խափաման միջոց է ընտրված եղել կալանավորումը:

Դատարանը, որպես ամբաստանյալի անձը բնութագրող հանգամանքներ է դիտել այն, որ նա դատապարտված չի եղել և Ավշար գյուղական համայնքի ղեկավարի կողմից բավարար է բնութագրվել:
