Մայրը նորածնին անգամ մատով չի դիպել․ Տավուշում կինը խեղդել է նորածնին, դիակը թաքցրել արտաթորանքի մեջ

168.am-ը գրում է.

Տավուշի մարզի ընդհանուր իրավասության դատարանի վճռով՝ 57-ամյա կինը մեղավոր է ճանաչվել աղջկա նորածին երեխային սպանելու մեջ՝ դատապարտվելով 10 տարվա ազատազրկման: Նրա նկատմամբ ընտրված խափանման միջոց կալանավորումը թողնվել է անփոփոխ` մինչև դատավճռի օրինական ուժի մեջ մտնելը:

57-ամյա կնոջը մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 104 հոդվածի 1-ին մասով՝ այն բանի համար, որ նա Նորաշեն գյուղում գտնվող իրենց առանձնատան պատշգամբում աղջկա՝ արտաամուսնական կապից հղիությունը թաքցնելու և նորածին երեխայի անցանկալի լինելու դրդապատճառով, ապօրինաբար կյանքից զրկելու նպատակով, դիտավորությամբ պարանոցի աջ և ձախ կողմնային երեսներից սեղմելու միջոցով մեխանիկական շնչահեղձության հասցնելով` սպանել է 36-38 շաբաթական տարիքում ծնված նորածին երեխային, այնուհետև նորածնի դիակը փաթաթել է պոլիէթիլենային պարկի մեջ, գցել արտաքնոցի փոսի մեջ և հողուրագով սեղմելով՝ դիակը թաքցրել արտաթորանքի մեջ:

Ըստ դատական ակտի՝ առաջադրված մեղադրանքում ամբաստանյալն իրեն մեղավոր չի ճանաչել և ցուցմունք է տվել այն մասին, որ դեպքից մեկ օր առաջ աղջկան տարել է հիվանդանոց` հղիությունն ընդհատելու համար, որտեղ բժիշկ-գինեկոլոգն ասել է, որ աղջիկը 4-5 ամսական հղի է, ինքը չի կարող հղիությունն ընդհատել, և առաջարկել է աղջկան տանել Երևան քաղաք: Բժիշկը թղթի վրա գրել է Երևան քաղաքի բժշկի հեռախոսահամարը, անուն-ազգանունը և տվել իրեն: Նույն օրը` երեկոյան, աղջիկն իրեն ասել է, որ կողքի շրջանում ծակոցներ ունի, որից հետո աղջկան ցավազրկող դեղ է տվել:

Ժամը 23:00-ի սահմաններում աղջիկն ասել է, որ ցանկանում է պատշգամբում պառկել, իսկ ինքը գնացել և պառկել է ներսի սենյակում: Աչքը կպել է և գիշերը` ժամը 3:00-ի սահմաններում, ձայնից արթնացել է, դուրս է եկել և տեսել աղջկան` արյան մեջ, իսկ կողքին մի բան կար ընկած: Երեխան մահացած է եղել: Իրեն կորցրել է և չի հասկացել, թե ինչ է կատարում: Աղջկա ծննդաբերության ժամանակ ինքը ներկա չի եղել: Շոշափել է երեխային և զգացել է, որ սառն է, երեխան չէր շնչում: Աղջկան ուշագնաց վիճակում տարել է հիվանդանոց, որտեղ էլ գիտակցության է եկել: Աղջկան հարցրել է, թե երեխան ծնվելու ժամանակ ձայն արձակե՞լ է: Նա պատասխանել է` երեխային ռետուզի մեջ փաթաթված` դրել է տոպրակի մեջ ու գցել զուգարանը: Աղջկա ձայնը չի լսել:

Ավելի վաղ մյուս աղջիկն իրեն ասել է, որ աղջիկն ուզում էր մկան դեղ ուտել: Երբ աղջկան հարցրել է, թե ինչի համար է ցանկանում մկան դեղ ուտել, արդյոք իրեն նեղացնող է եղել, վերջինս պատասխանել է, որ փորի մեջ բան է շարժվում: Հաջորդ օրը նրան տարել է հիվանդանոց: Մինչ այդ նրա հղիության մասին չի իմացել: Բժիշկն իրենց ասել էր, որ դստեր հղիությունը 3-4 ամսական է, իսկ հիմա պնդում է, որ 36-37 շաբաթական էր: Նորածնի վրա որևէ մարմնական վնասվածք չի նկատել: Երեխայի պարանոցից է բռնել ու դրել պարկի մեջ: Ինքը երեխային չի սպանել: Ինքն իր աղջկա վրա պորտալար է տեսել, սակայն նորածնի վրա չի տեսել, ինքը պորտալարը չի պոկել: Երեխայի ճիչ չի լսել: Աղջկա մոտ որևէ մեկը չի եղել: Իրենից բացի, այլ անձ նրա մոտ չի գնացել:

Դատարանն արձանագրել է, որ ամբաստանյալի նախաքննական ցուցմունքներն իրականությանը չեն համապատասխանում, նպատակ ունեն խուսափել պատասխանատվությունից ու պատժից և հերքվում են հետևյալ ապացույցներով։
