Հալաբյանում երկաթե թիթեղների տակ հայտնաբերված նորածնին այս պահին հնարավոր չէ որդեգրել. ԱՍՀՆ-ն մանրամասնում է ընթացակարգը

Որդեգրման գործընթացը հեշտ չէ, և պարզապես ցանկության կամ որևէ այլ հանգամանքի հիման վրա այն չի կարող կազմակերպվել։ Այս մասին «Փաստինֆո»-ին հայտնել է ՀՀ աշխատանքի և սոցիալական հարցերի նախարարի խոսնակ Նվեր Կոստանյանը՝ պատասխանելով այն հարցին, թե արդյոք հնարավոր է որդեգրել երեկ երկաթե թիթեղների տակ հայտնաբերված երեխային։Հիշեցնենք՝ երեկ՝ օգոստոսի 10-ին, ժամը 20:40-ի սահմաններում, Հալաբյան 13 շենքի խաղահրապարակում՝ երկաթե թիթեղների տակ, նորածին երեխա են հայտնաբերել։ Նորածին աղջկան տեղում անհրաժեշտ բուժօգնություն է ցուցաբերվել, կապել են պորտալարը և տեղափոխել Երևանի «Վերարտադրողական առողջության պերինատոլոգիայի, մանկաբարձության և գինեկոլոգիայի հանրապետական ինստիտուտ»։ Այս պահի դրությամբ երեխայի կյանքին վտանգ չի սպառնում։

«Մենք ընդհանրապես ունենում ենք որդեգրել ցանկացող անձանց և որպես որդեգրման ենթակա երեխաների ցանկ, որոնց հաշվառում ենք։ Որդեգրել ցանկացող անձինք նաև դասընթացներ են անցնում և այլն։ Բայց այս պահի դրությամբ, քանի որ երեխան նոր է հայտնաբերված, ինքը չի կարող համարվել որդեգրման ենթակա»,- նշել է խոսնակը։

Նշենք, որ Ընտանեկան օրենսգրքի 112-րդ հոդվածի 2.2-րդ կետի համաձայն՝ գտնված (ընկեցիկ) երեխան կարող է հաշվառվել որպես որդեգրման ենթակա երեխա՝ նրան հայտնաբերած մարմնի կամ անձի կողմից ոստիկանությանն ուղղված հարցմանն ի պատասխան՝ գտնված (ընկեցիկ) երեխայի ծնողներին չհայտնաբերելու վերաբերյալ համապատասխան գրությունն ստանալուց անմիջապես հետո։

«Ընկեցիկ երեխայի հայտնաբերումից հետո ոստիկանությունը երեք ամսվա ընթացքում պետք է միջոցներ ձեռնարկի երեխայի ծնողների հայտնաբերման ուղղությամբ, որից հետո ոստիկանությունն արդեն խնամակալության և հոգաբարձության մարմնի խողովակով, ինչը տվյալ պարագայում համայնքն է, երեխային հաշվառում է մեզ մոտ՝ որպես որդեգրման ենթակա երեխա, և արդեն կարող է որդեգրվել։

Բնականաբար, հեշտ գործընթաց չէ, պարզապես ցանկության կամ ինչ-որ բանի հիման վրա այդ գործընթացը չի կարող կազմակերպվել։ Ինչպես նշեցի՝ ընթացակարգ կա։ Այս պահին դա նկարագրեցի կոնկրետ հայտնաբերված երեխայի հետ կապված։ Ժամկետներ կան, և այս պահի դրությամբ դա մեր լիազորությունների շրջանակից դուրս է, քանի որ եռամսյա ժամկետում ոստիկանության կողմից ծնողին չհայտնաբերելու դեպքում միայն մեր կողմից է երեխան հաշվառվում և արդեն կարող է համարվել որդեգրման ենթակա»,- հավելել է Կոստանյանը։
