Այս պայմաններում՝ ՀՀ սեփականության իրավունքով գրանցված գույքերի և հողամասերի փոխանցումն Ադրբեջանին ի՞նչ է, եթե ոչ հանձնում. Գոհար Մելոյան

ԹԻՐԱԽԱՎՈՐՈՒՄ ԵՔ՝ ԹԻՐԱԽԱՎՈՐՎԵԼՈՎ

 2024 թվականի ապրիլ-մայիս ամիսներին, Տավուշի մարզում այսպես կոչված «սահմանազատման» գործընթացի ժամանակ, ՀՀ Սահմանադրությամբ եւ օրենքներով ԱՄՐԱԳՐՎԱԾ ՉԷՐ որևէ պետական մարմնի, հանձնաժողովի կամ դրա որևէ անդամի սահմանազատում իրականացնելու իրավասությունը:

«Հայաստանի Հանրապետության և Ադրբեջանի Հանրապետության միջև պետական սահմանի սահմանազատման և սահմանային անվտանգության հարցերով հանձնաժողովի ու Ադրբեջանի Հանրապետության և Հայաստանի Հանրապետության միջև պետական սահմանի սահմանազատման պետական հանձնաժողովի համատեղ գործունեության մասին» կանոնակարգը վավերացնելու մասին ՀՀ օրենքը օրինական ուժի մեջ է մտել միայն 2024 թվականի հոկտեմբերի 24-ին։

Տավուշի հատվածում միակողմանի զիջումներ անելուց մոտ 6 ամիս անց:

Այսինքն՝ 2024 թվականի ապրիլ-մայիս ամիսներին Տավուշում իրականացված սահմանազատումը կատարվել է ԱՌԱՆՑ իրավական հիմքի:

Ըստ ԶԼՄ-ներում առկա տարբեր հրապարակումների՝ սահմանազատման արդյունքում Ադրբեջանին են անցնել:

 2 բնակելի տուն, 3 խանութ, 1 ավտոմասերի կետ, 48 հողամաս և մի քանի հեկտար համայնքային հողեր։

Այդ անշարժ գույքերի սեփականության իրավունքի վկայականներում որպես գտնվելու վայր նշված է Տավուշի մարզ, Կիրանց, իսկ դրանք տրված են եղել ՀՀ պետական մարմինների կողմից:

Այսինքն՝ ՀՀ պետական մարմինները:

ճանաչել են այդ հողամասերի նկատմամբ ՀՀ իրավազորությունը, համարել են այդ անշարժ գույքները Կիրանց համայնքի մաս, դրանց հետ իրականացրել են աճուրդներ, օտարման և այլ գործարքներ։

Այս պայմաններում՝ ՀՀ սեփականության իրավունքով գրանցված գույքերի և հողամասերի փոխանցումն Ադրբեջանին՝ առանց պատշաճ օրենսդրական հիմքի, ի՞նչ է, եթե ոչ հանձնում:

«Հայաստանի Հանրապետության վարչատարածքային բաժանման մասին» օրենքով Կիրանցը ճանաչվում է որպես Տավուշ մարզի համայնք՝ իր վարչական տարածքով:

 ՀՀ Սահմանադրության 205-րդ հոդվածի համաձայն՝ Հայաստանի Հանրապետության տարածքի փոփոխությանը վերաբերող հարցերը լուծվում են ՀԱՆՐԱՔՎԵՆԵՐԻ միջոցով:

Այսինքն՝ միայն ընտրական իրավունք ունեցող ՀՀ քաղաքացին կարող էր այդ տարածքների փոփոխության վերաբերյալ որոշում կայացներ, ինչը ԽԱԽՏՎԵԼ Է:

Եւ, վերջապես, մենք ունե՞նք անկլավներ Տավուշի մարզում եւ առհասարակ։
