Լաբավոյ խլեշա անում, մագազինը պրծցրել եմ վրեն, ով էլ ըլներ` նույնը կաներ. Զինվորը սպանել է ծառայակցին

ՀՀ ՊՆ N զորամասի շարքային Ռազմիկ Խուդավերդյանը մեղավոր է ճանաչվել ՀՀ քրեական օրենսգրքի 104-րդ հոդվածի 1-ին մասով՝ սպանություն, և ՀՀ քրեական օրենսգրքի 38-361-րդ հոդվածի 1-ին մասով՝ զորամասն ինքնակամ թողնելուն օժանդակելը, և դատապարտվել 9 տարի 9 ամսվա ազատազրկման:

Իսկ զորամասի շարքային Նարեկ Խաչատրյանը մեղավոր է ճանաչվել ՀՀ քրեական օրենսգրքի 361-րդ հոդվածի 1-ին մասով՝ զորամասն ինքնակամ թողնելը, և դատապարտվել 3 ամսվա պայմանական կալանքի՝ 2 տարվա փորձաշրջանով:

Դատարանը հաստատված է համարել, որ 2016 թվականի հոկտեմբերի 7-ից Ռազմիկ Խուդավերդյանը և Վահագն Վիրաբյանն ու այլ զինծառայողներ մարտական հերթապահություն են իրականացրել մարտական դիրքում, նրանք հերթապահության գրաֆիկի համաձայն, ընդգրկված են եղել միևնույն հերթափոխում:

Հերթապահության 3-րդ օրից Վահագն Վիրաբյանը սահմանված կարգով չի կատարել դիտորդի պարտականությունները, այն է` քնել է, ինչի պատճառով Ռազմիկ Խուդավերդյանը բազմիցս դիտողություն է արել նրան:

2016 թվականի հոկտեմբերի 15-ին` ժամը 00:00-ից մինչև ժամը 03:00-ն, Վահագն Վիրաբյանը կրկին քնել է դիտորդի և կապավորի պարտականությունները կատարելիս: Նշված հանգամանքի վերաբերյալ Ռազմիկ Խուդավերդյանը տեղյակ է պահել դիրքի ավագին ու նրա օգնականին ու խնդրել փոխարինել Վահագն Վիրաբյանին մեկ այլ զինծառայողի հետ, սակայն նրանք մերժել են Ռազմիկ Խուդավերդյանի խնդրանքը, զրուցել են Վահագն Վիրաբյանի հետ, ով հավաստիացրել է, որ այլևս չի քնի:

2016 թվականի հոկտեմբերի 15-ին` ժամը 08:00-ի սահմաններում, Ռազմիկ Խուդավերդյանը և Վահագն Վիրաբյանը ստանձնել են առաջնագծի դիտորդի պարտականությունները: Այդ ժամանակ Վահագն Վիրաբյանն ասել է, որ Ռազմիկ Խուդավերդյանի կողմից իր քնելու վերաբերյալ դիրքի ավագին տեղյակ պահելը «լավ տղայի» քայլ չէ և որ գնան զորամաս նրա նկատմամբ վատ է վերաբերվելու` «գառլախելու է»:

Ռազմիկ Խուդավերդյանը նրան պատասխանել է, որ ոչ ոք չի կարող իր նկատմամբ այդպես վերաբերվել: Դրանից հետո Վահագն Վիրաբյանը հայհոյել է Ռազմիկ Խուդավերդյանին, վերջինս լսելով հայհոյանքը՝ բացել է իրեն ամրակցված «ԱԿ-74» տեսակի ինքնաձիգի ապահովիչը, դրել կրակահերթ դիրքի վրա, լիցքավորել, փողն ուղղել Վահագն Վիրաբյանի վրա և արձակել կրակահերթ, ինչի հետևանքով վերջինս մահացել է:

Դրանից հետո Ռազմիկ Խուդավերդյանը եկել է մարտական դիրքի գետնատնակի մոտ և զինծառայողների հարցին, թե ինչ է պատահել, պատասխանել է, որ «լաբավոյ խլեշա անում, բա չխփեի», «Վահագնը սրբությանս քֆուր ա արել, մագազինը պրծցրել եմ վրեն, ով էլ ըլներ` նույնը կաներ», «թող դատեն, ես քֆուրի տակ չեմ մնա»:

Դատարանը փաստել է, որ վրեժի էությունը չարիք պատճառողին «հատուցելու», նրան վնաս պատճառելու հոգեկան պահանջմունքն է: Նշված շարժառիթով սպանությունն իր մեջ ինքնադատաստանի տարրեր է պարունակում, քանի որ համապատասխան մարմիններին դիմելու փոխարեն հանցավորը ինքն է «պատժում» իրեն նեղացնողին, իսկ հոգեկան խիստ հուզմունքի դեպքում կատարված սպանության ժամանակ հանցավորը զրկված է իր արարքի հետևանքները խելամիտ և բազմակողմանի կշռադատելու հնարավորությունից:
