Կարապետ Գուլոյանը գույքը չի վնասել, չնայած համաձայն չէ, որ գույքն ապօրինի է, բայց պատրաստ է վճարել, և իր հայրական տունը պահել ընտանիքի տիրապետության տակ․ փաստաբան

Կոտայքի նախկին մարզպետ Կարապետ Գուլոյանը չի քանդել այն գույքը, որն՝ ըստ Վճռաբեկ դատարանի, համարվել է ապօրինի և պետությանը վերադարձի ենթակա։ Այս մասին Hayastan.news-ի հետ զրույցում ասաց փաստաբան Էմին Խաչատրյանը, անդրադառնալով այն հրապարակումներին, թե դիտավորյալ գույքը վնասվել է։

-Պարոն Խաչատրյան, այն գույքը, որը դատարանը ճանաչել է ապօրինի և որը պատկանում էր Կարապետ Գուլոյանին, Վճռաբեկ դատարանի որոշման հրապարակումից հետո որևէ փոփոխության,կամ վնասման ենթարկվել է։

-Նախ՝ դրանք վերանորոգման աշխատանքներ են եղել, հիմա կներկայացնեմ ժամանակագրությունը։ Դա եղել է վերանորոգում, ոչ թե գույքը քանդել կամ վնասել։ Երբ սկսվել են վերանորոգման աշխատանքները, այն ժամանակ դեռ ապօրինի ծագում ունեցող գույքի վերաբերյալ դատական ակտերն օրինական ուժ ստացած չեն եղել, նույնիսկ Վճռաբեկ դատարանի որոշումը չի եղել։  Այդ գույքն ունեցել է որոշակի խնդիրներ, և այնտեղ  կատարվել են վերանորոգման աշխատանքներ։ Այսինքն, այդ սալիկները քանդվել են, ավելի նոր սալիկներով փոխարինվելու, ավելի լավ որակ ապահովելու համար։ Շինաշխատանքներ կատարող անձանց ձերբակալել են շինհրապարակից, ովքեր կարծում եմ և համոզված եմ, որ պնդել են, որ նշված վայրում ոչ թե քանդման, այլ վերակառուցման աշխատանքներ են տեղի ունենում։ Այսինքն, Կարապետ Գուլոյանի կողմից գույքը վնասելու առիթ, դիտավորություն չի եղել։

-Իսկ Վճռաբեկի այդ որոշումն ընդունվել է ի գիտությու՞ն, և այլ քայլեր չե՞ն արվելու։

-Մինչ այդ, ևս մեկ փաստ նշեմ, թե ինչո՞ւ Գուլոյանը չէր քանդի այդ գույքը։ Նրա կողմից կա պատրաստակամություն և ցանկություն բանակցելու պատկան մարմինների հետ, որպեսզի իր հայրական տունը պահի իր ընտանիքի տիրապետության տակ, հաշվի առնելով՝ այն հանգամանքը, որ պատրաստ է վճարելու պետության կողմից հաշվարկված գումարը, շուրջ 2,5 մլն դոլարին համարժեք դրամ։  Ըստ Վճռաբեկ դատարանի որոշման՝ 90 տոկոսը պետությանն է, 10 տոկոսը՝ Գուլոյաններինը։ Կարապետ Գուլոյանը ցանկություն է հայտնել, հիմա էլ ունի այդ ցանկությունը, որպեսզի այդ գույքը առնի պետությունից և հայրական օջախը մնա իրեն։

-Հայրական տան պարագայում ձեր վստահորդը հա՞շտ է այդ որոշման հետ, որ ապօրինի է գույքը։ Ներպետական ատյաններից զատ միջազգային ատյաններ դիմելու մտադրություն կա՞, թե ոչ։

-Անկախ այն հանգամանքից, որ Կարապետ Գուլոյանը համաձայն չէ, որ ինքը ապօրինի գույք ունի, մենք ունենք իրավիճակ, որ դատական ակտն օրինական ուժ է ստացել։ Հետևաբար, Կարապետ Գուլոյանը լինելով իրավահպատակ վարքագիծ դրսևորող, պատրաստակամ է  վճարել այդ գումարը, անկախ հետագա գործունեությունից՝ միջազգային ատյաններ դիմել-չդիմելուց։

-Ինչու՞ է պետությունը ձգձգում համաձայնել, կամ գուցե չհամաձայնելըգնալ այդ գործարքին, կարո՞ղ է դա քաղաքական որոշում լինել, որովհետև պետության ու սեփականատերերի միջև հաշտության գնալու նախադեպեր եղել են։

-Քաղաքական նպատակները ես չէ որ պետք է մեկնաբանեմ, բայց բոլորն էլ կարող են դատողություն անել, թե ինչ իրավիճակում է գտնվում Հայաստանը, ինչ գործընթացներ են Հայաստանում, և միգուցե այդ հնարավոր չհամաձայնելը, կամ հնարավոր բնակացությունների չգնալը կարող է դիտարկվել քաղաքական տեսակետից։

Ամեն պարագայում, եթե Կարապետ Գուլոյանը ցանկանար գույքը վնասել, ապա չէր վնասի վերակառուցման եղանակով, գույքն առավել արագ վնասելու, չվերականգնելու ենթակա բազմաթիվ այլ ձևեր կան։
