Նախընտրական ևս մեկ «տեսլական», որի անհրաժեշտությունը մեկ տարի առաջ «բացակայում» էր. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Օրերս կառավարությունն ընդունել է Հարկային և Քրեական օրենսգրքերում փոփոխություններ կատարելու, ինչպես նաև Քրեական դատավարության օրենսգրքում լրացում կատարելու մասին նախագծերին հավանություն տալու, նախաձեռնությունն անհետաձգելի համարելու և Ազգային ժողով ներկայացնելու մասին որոշում:

Կառավարությունն առաջարկում է վերանայել հարկերից խուսափման դեպքում քրեական պատասխանատվության խոշոր և առանձնապես խոշոր չափերի շեմերը, տարբերակել մեկ կամ մի քանի հարկային տարիներում ձևավորված պարտավորությունները։ Նախագծով սահմանվում է ավելի բարձր շեմ՝ համապատասխանաբար 10 միլիոն դրամից մինչև 30 միլիոն դրամի (կամ 2 տարվա համար՝ 45 միլիոն դրամ) և 20 միլիոն դրամից մինչև 50 միլիոն դրամի (կամ 3 տարվա համար՝ 75 միլիոն դրամ)։

Կրկնենք՝ այս նախաձեռնությունը կառավարությունը համարել է անհետաձգելի: Այսինքն, այն անհրաժեշտ է ընդունել մինչև ընտրություններ: Հարցն այն է, սակայն, որ դեռևս 2025 թվականի հունվարի 24-ին «Հայաստանը ես եմ» նախաձեռնությունը պաշտոնապես դիմել էր ՀՀ կառավարությանը՝ առաջարկելով վերանայել ՀՀ Քրեական օրենսգրքի 290-րդ հոդվածը։ Առաջարկը հստակ էր՝ սահմանել քրեական պատասխանատվության շեմ՝ 50 միլիոն դրամի չափով, ինչպես նաև օրենքում ամրագրել, որ պատասխանատվությունից ազատման հիմք կարող է հանդիսանալ չվճարված հարկերի, տուրքերի կամ այլ վճարների ամբողջական մարումը՝ առանց տույժերի հաշվարկի։ Առաջարկը ներկայացվել էր իր ամբողջական հիմնավորումներով՝ ուղղված բիզնես միջավայրի կանխատեսելիության բարձրացմանը, ավելորդ քրեական ռիսկերից ազատմանը և տնտեսական գործունեության խթանմանը։ Սակայն կառավարությունը հարցը «ջրել» էր, թե փոփոխությունների անհրաժեշտությունը բացակայում է։

Բայց, ինչպես այս կառավարության պարագայում հաճախակի է լինում (դե, մի երկու ամիս թոշակ բարձրացնելու ո՛չ փող կար, ո՛չ անհրաժեշտությունը, մեկ էլ «հանկարծ» որոշեցին բարձրացնել), այս դեպքում ևս մեկ տարի անց՝ խորհրդարանական ընտրություններին ընդառաջ, «պարզվել է», որ այդ փոփոխությունների անհրաժեշտությունը «հայտնվել» է։ Ավելին, պարզվում է, որ այդ փոփոխությունը բխում է Պետական եկամուտների կոմիտեի «տեսլականից»: Թե ինչպես ընտրություններից առաջ հայտնվեց այդ «տեսլականը», որը բացակայում էր մեկ տարի առաջ, մտածելու տեղիք է տալիս: Այսինքն, ոչ էլ տեղիք է տալիս. ակնհայտ է, որ սա հերթական նախընտրական «տեսլականն» է, որը կառավարությունը փորձում է ներկայացնել որպես մեծ լավություն, թեպետ, ըստ մասնագետների, այս փոփոխությունը դեռ վաղուց պետք է կատարվեր: Բայց, դե, ընտրություններն իրենց «կանոններն» ունեն:
