Ինչու է Իրանում պատերազմը միջազգային իրավունքի համար դառնում շրջադարձային պահ

Էդմոն Մարուքյանը տելեգրամյան իր ալիքում գրում է.

«Ես կարծում եմ, որ միջազգային իրավունքի մասնագետների մեծ մասը համաձայն է, որ (Իրանի դեմ իրականացվող ռազմական գործողությունը – խմբ.) չունի անհրաժեշտ իրավական հիմնավորում», — DW-ին ասել է ամերիկյան Atlantic Council վերլուծական կենտրոնի իրավաբան Գիսսու Նիան։ Նա ընդգծում է, որ Իրանի տարածքի վրա իրականացվող ավիահարվածները նաև խախտում են ԱՄՆ օրենքները, որոնք կարգավորում են պատերազմի սկսման կարգը։

Թշնամի պետության ղեկավարի սպանությունը միջազգային իրավունքում ևս մեկ վիճահարույց հարց է։ Եթե այն իրականացվել է միտումնավոր և չի պայմանավորվել հանգամանքներով, ապա կարող է դիտարկվել որպես մահափորձ և համարվել ՄԱԿ-ի կանոնադրության խախտում։ Բացի այդ, ԱՄՆ-ում դեռևս 1970-ականների վերջից՝ նախագահ Ջերալդ Ֆորդի նախաձեռնությամբ, գործում է արգելք, որը արգելում է ամերիկացիների մասնակցությունը այլ պետությունների քաղաքական առաջնորդների սպանություններին։

Ինչպես նշում է Մեծ Բրիտանիայի Սուոնսի համալսարանի միջազգային հարաբերությունների ամբիոնի պրոֆեսոր Լուկա Տրենտան, վերջին մի քանի տասնամյակների ընթացքում Վաշինգտոնը աստիճանաբար վերացրել է այդ արգելքի սահմանները։ DW-ի հետ զրույցում նա պարզաբանել է, որ ԱՄՆ-ը կարծում է՝ «ինքնապաշտպանության նպատակով իրականացված գործողությունները» չեն արգելվում այդ հրամանագրով։

DW-ի կողմից հարցված փորձագետները զգուշացնում են․ որքան ավելի հաճախ են ազդեցիկ պետությունները դիմում միջազգային իրավունքի նորմերի լայն մեկնաբանությանը՝ ընդունելով կանխարգելիչ հարվածները որպես ինքնապաշտպանություն, այնքան ավելի են թուլանում միջազգային իրավունքի այն դրույթները, որոնք կոչված են կանխելու պատերազմները, և դրանք աստիճանաբար դադարում են գործել։
