Արցախում պայթյnւնի հետևանքով կորած մարդիկ կհամարվեն անհետ կորած. նախագիծ

Արցախի մայրաքաղաք Ստեփանակերտի մերձակայքում բենզինի պահեստում պայթյունի հետևանքով անհետ կորած անձանց ընտանիքները կստանան նույն աջակցությունը, ինչ պատերազմում անհետ կորածները։ Ազգային ժողովում 2-րդ ընթերցմամբ «Ռազմական գործողությունների հետևանքով ստեղծված պայմաններում և հանգամանքներում անհայտ կորած անձանց մասին» և կից ներկայացված օրենքների նախագծերի փոփոխության փաթեթը ներկայացրեց ՀՀ արդարադատության նախարար Սրբուհի Գալյանը, փոխանցում է Սպուտնիկ Արմենիան:

Նշենք, որ 2023 թվականի սեպտեմբերի 25-ին Ստեփանակերտ-Ասկերան ավտոճանապարհի մերձակայքում բենզինի պահեստի պայթյունի հետևանքով 219 անձ զոհվել է, 22-ը անհետ կորել, ևս 300-ը վիրավորվել են։ Այժմ զոհվածների հարազատները բարձրաձայնում են խնդրի մասին պահանջելով որևէ կարգավիճակ տալ իրենց։

Երբ պայթյունի հետևանքով տուժած անձանց խնդիրն ԱԺ–ում բարձրաձայնեցին նաև ԱԺ «Հայաստան» խմբակցության պատգամավորները, նախարարը մանրամասներ ներկայացրեց։

«Անհետ կորած անձ հասկացությունն իր մեջ պարունակում է նաև խաղաղ պայմաններում զոհված անձանց, կամ այն անձանց, որոնք զոհվել կամ անհետ կորել են պատերազմական գործողություններին հաջորդող 6 ամսվա ընթացքում, կամ պատերազմական գործողությունների ժամանակ` չմասնակցելով դրանց։ Այսինքն` այն սուբյեկտները, որոնց մասին դուք խոսում եք, օրենքի նախագծով ներկայացված են որպես անհայտ կորած անձինք»,– ասաց Գալյանը։

Նախարարի խոսքով` ռազմական գործողությունների հետևանքով ստեղծված պայմաններում անհետ կորած անձանց մասին համապարփակ օրենսդրություն մինչ օրս չկա:

Նշենք, որ քննարկվող օրենսդրական փաթեթով առաջարկվում է սահմանել, թե ով է համարվում անհետ կորած անձ, ինչպես նաև ամրագրել անհետ կորած անձանց ու նրանց ընտանիքների անդամների իրավունքները: Սահմանվում են անհետ կորած անձի հետախուզման համար դիմում ներկայացնելու ընթացակարգերը, հետախուզման գործընթացին առնչվող դրույթները և հետախուզման դադարեցման դեպքերը: Նախատեսվում է լիազոր մարմնի ներքո ստեղծել անհետ կորած անձանց միասնական ռեեստր, որի տվյալները հասանելի են լինելու անհայտ կորած անձանց ընտանիքի անդամներին, պետական և տեղական ինքնակառավարման մարմիններին: Սահմանվելու է անհետ կորած անձանց և նրանց ընտանիքի անդամներին տրամադրվող արտոնությունների շրջանակը:
