Փաշինյանը վերջնականապես յուրացրեց Սահմանադրական դատարանը

Սահմանադրական դատարանի դատավոր Հրայր Թովմասյանի նկատմամբ կայացրած վճիռը մտել է օրինական ուժի մեջ։ Անցած տարվա սեպտեմբերին Վերաքննիչ հակակոռուպցիոն դատարանն անփոփոխ էր թողել ՀՀ արդարադատության նախկին նախարար Հրայր Թովմասյանի վերաբերյալ Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի դատավճիռը, որով վերջինս մեղավոր էր ճանաչվել երկու դրվագով, բայց ազատվել էր քրեական պատասխանատվությունից՝ վաղեմության ժամկետները 2019 թվականին անցած լինելու պատճառաբանությամբ։ Դատավճռի դեմ դատախազի կողմից ներկայացվել էր վերաքննիչ բողոք՝ արարքների վերաորակման և վաղեմության ժամկետի կիրառման մասով, իսկ պաշտպանների կողմից ներկայացվել էին վերաքննիչ բողոքներ՝ խնդրելով ճանաչել Հրայր Թովմասյանի անմեղությունը։

Վերաքննիչ հակակոռուպցիոն դատարանը 2025 թվականի սեպտեմբերի 30-ին որոշում էր կայացրել բողոքները մերժելու և դատավճիռն անփոփոխ թողնելու մասին։ Հակակոռուպցիոն վերաքննիչ քրեական դատարանի՝ 2025 թվականի սեպտեմբերի 30-ի որոշման դեմ ՀՀ գլխավոր դատախազը, Թովմասյանը և նրա պաշտպանը ներկայացրել էին վճռաբեկ բողոքներ։ Վճռաբեկ դատարանի հակակոռուպցիոն պալատը 2026 թվականի փետրվարի 12-ին որոշում է կայացրել ներկայացված բողոքները վարույթ ընդունելը մերժելու մասին, ինչը նշանակում է, որ Հրայր Թովմասյանի վերաբերյալ կայացված մեղադրական դատավճիռը 2026 թվականի փետրվարի 12-ից մտել է օրինական ուժի մեջ։

Փաստացի, սա նշանակում է, որ օրենքի ուժով Հրայր Թովմասյանն այլևս չի կարող պաշտոնավարել որպես ՍԴ դատավոր։ Թովմասյանը Սահմանադրական դատարանում մնացած վերջին դատավորն էր, որ դիմադրում էր Նիկոլ Փաշինյանի ապօրինություններին։ Մի առիթով նա իր պաշտոնավարումը համեմատել էր «խրամատ պահելու» հետ։ Այժմ, ըստ էության, ՍԴ-ում խրամատ չի մնացել, ինչպես և չկա որևէ դատավոր, որը կհանդգնի դեմ գնալ Նիկոլ Փաշինյանի կամքին։
