Հօգուտ ՀՀ-ի՝ կբռնագանձվի 1 միլիոն 600 հազար դոլարին համարժեք դրամ․ դատախազություն

Գլխավոր դատախազությունը տեղեկացրել էր, որ պետական շահերի պաշտպանության վարչության հերթական հայցադիմումը Հակակոռուպցիոն դատարանի՝ 2025 թվականի փետրվարի 26-ի վճռով, մասնակիորեն բավարարվել է: Վճռի հիման վրա՝ հօգուտ Հայաստանի Հանրապետության Ա.Հ.-ից, Գ.Մ.-ից և Բ.Ա.-ից, որպես պետությանը պատճառված վնասի հատուցում, կբռնագանձվի 1 միլիոն 600 հազար ԱՄՆ դոլարին համարժեք 629 միլիոն 610 հազար դրամ:

2025 թվականի մարտի 28-ին պատասխանողների կողմից վճռի դեմ ներկայացվել էր վերաքննիչ բողոք, որը Վերաքննիչ հակակոռուպցիոն դատարանի որոշմամբ մերժվել էր:

Վերաքննիչ հակակոռուպցիոն դատարանի որոշման դեմ պատախանողների կողմից ներկայացվել էր վճռաբեկ բողոք, որի վարույթ ընդունելը Վճռաբեկ դատարանի՝ 2026 թվականի փետրվար 11-ի որոշմամբ մերժվել է. Հակակոռուպցիոն դատարանի՝ 2025 թվականի փետրվարի 26-ի վճիռը մտել է օրինական ուժի մեջ:

Հիշեցնենք, որ Երևան քաղաքի ընդհանուր իրավասության առաջին ատյանի դատարանի կողմից քննվող թիվ ԵԿԴ/0050/01/16 քրեական գործի շրջանակներում պարզվել էր, որ Կառավարությանն առընթեր հարկային պետական ծառայության օպերատիվ-հետախուզության վարչության պետի նախկին տեղակալ Գ.Մ.-ի հանձնարարությամբ` օպերատիվ-հետախուզության վարչության 6-րդ բաժնի պետ Ա.Հ.-ն, նույն բաժնի օպերլիազորներ Պ.Հ.-ն և Բ.Ա.-ն սահմանափակ պատասխանատվությամբ ընկերությունում ստուգումն իրականացրել էին ոչ պատշաճ: Արդյունքում՝ 2007 թվականի նոյեմբերի 22-ին կազմված ստուգման ակտով ընկերությանն առաջադրվել էր ընդամենը 3 միլիոն 605 հազար դրամի լրացուցիչ հարկային պարտավորություն այն դեպքում, երբ արձանագրման ենթակա լրացուցիչ պարտավորությունը պետք է կազմեր 299 միլիոն 342 հազար դրամ:

Վերոնշյալ վարչության 6-րդ բաժնի պետ Ա.Հ.-ի հանձնարարությամբ՝ նույն բաժնի օպերլիազորներ Պ.Հ.-ն և Բ.Ա.-ն նույն սահմանափակ պատասխանատվությամբ ընկերությունում 2008 թվականին նշանակված ստուգումը կրկին իրականացրել էին ոչ պատշաճ: Արդյունքում՝ 2008 թվականի դեկտեմբերի 30-ին կազմված թիվ 1001538 ստուգման ակտով Ընկերությանն առաջադրվել էր ընդամենը 6 միլիոն դրամի լրացուցիչ հարկային պարտավորություն այն դեպքում, երբ արձանագրման ենթակա լրացուցիչ պարտավորությունը պետք է կազմեր 330 միլիոն 267 հազար դրամ։
