Իշխանություններին պետք չեն ո՛չ օբյեկտիվ դիտորդներ, ո՛չ արդար ընտրություններ. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Հայաստանի գործող իշխանությունները, հասկանալով, որ արդար, ազատ ընտրությունների պարագայում վերընտրվելու որևէ շանս չունեն, աստիճանաբար կիրառում են տարբեր «գործիքներ»՝ ազատորեն ընտրությունները կեղծելու, դրանց արդյունքները աղճատելու համար: Դրա վառ վկայությունն է Ընտրական օրենսգրքում փոփոխություններ և լրացումներ կատարելու նախաձեռնությունը:

Փոփոխությունները, որոնք վերաբերում են ընտրությունների ժամանակ դիտորդական առաքելությունների գործունեությանը, իշխանությունները «սիրուն» փաթեթավորել են, օրինակ՝ նշելով, թե նպատակ կա «ապահովել ընտրական գործընթացի անկախ, օբյեկտիվ եւ անաչառ գնահատականը՝ ընտրությունների օրինականությունն ու հավաստիությունն ապահովելու համար», իրականում, ինչպես նշում են անկախ փորձագետներն ու ընդդիմադիրները, առաջարկվող օրինագիծն ուղղված է իշխանությունների ցանկությանը՝ ամբողջությամբ վերահսկել ընտրական գործընթացը: Նախ պետք է նշել այն հանգամանքը, որ այս փոփոխությունն արվում է ընտրություններից ընդամենը 4 ամիս առաջ, այնինչ, ընդունված կարգն այն է, որ ընտրություններից առնվազն 1 տարի առաջ պետք է նման կարգի փոփոխությունների «մորատորիում» լինի: Հաջորդ խնդիրն այն է, որ փոփոխությունները օրակարգ են բերվում հապճեպ, գաղտնի և ընդունվում են «ոտքի վրա», «արագի մեջ», առանց պատշաճ հանրային քննարկումների: Ընդ որում, քանի որ ընդդիմությունը հրաժարվել է մասնակցել այս «ֆարսի» քվեարկությանը, քպականները հազիվ կարողացան ապահովել անհրաժեշտ քվեներն ու «անցկացնել»:

Մյուս կողմից՝ դատելով թե՛ հիմնական զեկուցողի, թե՛ այլ քպականների ելույթներից, այս փոփոխություններն առաջին հերթին ուղղված են «ՀայաՔվեի» դեմ, որը հատկապես նախորդ ՏԻՄ ընտրություններում ջանք ու եռանդ չի խնայել կանխելու իշխանությունների ապօրինությունները: Եվ ընդհանրապես, այս փոփոխություններով, քանի որ քաղաքական չեզոքության հետ կապված առկա են չափազանց սուբյեկտիվ ձևակերպումներ, ԿԸՀ-ին հնարավորություն է տրվում ցանկացած պատրվակով չգրանցել այն դիտորդական առաքելություններին, եթե դրանք իշխանությունների «գրպանային» դիտորդները չեն: Փոխարենը կգրանցեն «յուրային» դիտորդներին, որոնք իրապես քաղաքականացված են (ԱԺ-ում որպես օրինակ բերվեց Դանիել Իոաննիսյանի կառույցը), բայց կարևորը՝ քաղաքականացված են հօգուտ իշխանությունների: Այսինքն, ամեն ինչ կանեն, որ իրապես անկախ, օբյեկտիվ դիտորդներ չմասնակցեն առաջիկա ընտրություններին:

Ի դեպ, երեկ մեզ հետ զրույցում մի քանի իրավաբաններ նշում էին, որ այս փոփոխությունները նաև հակասահմանադրական են, քանի որ խախտում են որոշակիության սկզբունքը: Ըստ այդմ, չի բացառվում, որ ՍԴ դիմելու նախաձեռնություն լինի:
