2025 թվականի դեկտեմբերի 30-ին Հակակոռուպցիոն դատարանի դատավոր Սարգիս Պետրոսյանի որոշմամբ Սամվել Կարապետյանի նկատմամբ կիրառված կալանքը փոփոխվել է տնային կալանքի, համակցված գրավով, ինչպես նաև բացակայելու արգելքով, լրացուցիչ սահմանափակումներով՝ հրապարակային խոսքին վերաբերող։ Այս մասին այսօր հրավիրված ասուլիսի ժամանակ հայտարարել է գործարարի պաշտպանական խմբի անդամ Արամ Վարդևանյանը։

«Իհարկե, այս ամենը էական սահմանափակումներ են, բայց մյուս կողմից ունեցանք մի իրավիճակ, որ 2025 թ-ի հունիսի 18-ից մինչ օրս եղավ մեկ դատավոր, ով պատկերացրեց, որ իսկապես քրեական դատավարության օրենսգրքում կալանքից բացի կա այլ խափանման միջոց, քանի որ մինչ այդ պահը նշվածը որևէ ձևով չէր արձանագրվում։

«Արդյոք նշվածը մի մեծ հաջողություն էր, բնականաբար՝ ոչ։ Սամվել Կարապետյանի գործով,ըստ էության, հաջողություն արձանագրելու հանգամանք չունենք էլ, քանի որ այստեղ գործ չկա։ Ինչ տեղի ունեցավ այդ ժամանակահատվածին անմիջապես հաջորդող տեսանկյունից։ 2026 թ-ի հունվարի 5-ին Քննչական կոմիտեի և Դատախազության կողմից կատարվեցին երկու «չափազանց կարևոր» գործողություններ։ Առաջինն արգելեցին, որ Սամվել Կարապետյանը Մեռելոց հիշատակի օրը, իր հոր գերեզմանին այցելելի։ Մեր արժեհամակարգում սա չլսված բան է, սա իսկապես ամոթ է։

Բայց այդ օրը դրանով չէին սահմանափավել մեր գործընկերները։ Մուտքագրել են վերաքննիչ բողոք Վերաքննիչ հակակոռուպցիոն դատարան։ Հարց է առաջանում՝ ինչ պետք է գրած լինեին այդ բողոքում։ Այնտեղ երկու խումբ հարցեր կային, որոնք Առաջին ատյանի դատարանը հիմք էր ընդունել, որպեսզի դիտարկվեր՝ կալանքը ենթակա էր վերացման, թե ոչ։ Մեկը վերաբերում էր ջանասիրությանը, քանի որ նոյեմբերի 18-ից մինչև դեկտեմբերի 25-ն այնքան դիմում-միջնորդությունն էինք ներկայացրել Քննչական մարմնին, որ վերջիններս գործողություն կատարեն։ Մենք խնդրել ենք, որ նախաքննությունն ավարտեն, ունենանք հրապարակային դատաքննության հնարավորություն դռնբացության կարգով, բայց ոչ դա են արել, ոչ էլ այլ գործողություն։ Մենք ասում ենք՝ գործ արեք, իրենք ասում են՝ անհիմն միջնորդություններ եք անում։ Սա է իրականությունը»,- նշել է փաստաբանը։
