Դատարանների նկատմամբ անասելի ճնշումներ կան. Արմեն Ֆերոյան

Դեռևս Սամվել Կարապետյանի խափանման միջոցի քննարկման ժամանակ ես ներկայացրեցի, որ ծավալուն քրեական գործ են ներկայացրել, բայց որևիցե փաստական տվյալ չկա, որ այդ գործը կապ ու առնչություն ունի Սամվել Կարապետյանի հետ,  հրավիրված ասուլիսի ժամանակ ասաց Կարապետյանի փաստաբան Արմեն Ֆերոյանը։

Նրա խոսքով՝ այդ գործի մեջ  տարբեր ընկերությունների, տարբեր մարդկանց անուններ են, բայց  փաստական հիմքն ու հիմնավորվածությունը, որ այդ գործը կապ ու առնչություն ունի Սամվել Կարապետյանի հետ, զրոյական է։

 «Իրականում գործ ունենք բացառապես քաղաքական հետապնդման հետ։ Քննչական մարմինն ի սկզբանե միայն մեղադրող մարմին չէ, այլև անձի անմեղությունը հիմնավորող, ապացույցներ ձեռք բերող  կառույց է։ ՔԿ-ն ինչպես պետք է ապացույցներ ձեռք բերի մեղավորությունը հաստատելու համար, այնպես էլ պետք է ձեռք բերի անմեղությունը հերքող ապացույցներ։ Բայց այս քրեական գործն այն բացառիկներից է, որում պաշտպանական կողմը թերևս կարողացել է պաշտոնապես հասնել նրան, հիմնավորել ու ապացուցել, որ վարույթ իրականացնող մարմինը ձեռք է բերում բացառապես շինծու և մեղադրական թեքումով ապացույցներ։ Ու այն հարցադրմանը, թե, օրինակ՝ ինչո՞ւ այս մարդուն չեք հարցաքննել, մեզ տրվող պատասխանը շատ ուղիղ ու դիպուկ է՝ չենք հարցաքննել, որովհետև մտավախություն ունենք, որ այդ մարդը հնարավոր է հօգուտ ձեզ է ցուցմունք տալու»,-ասաց փաստաբանը։

Նա հավելեց, որ այդ հայտարարությունն արել է քննչական խմբի ղեկավար Սպարտակ Պողոսյանը, որը դուրս է վերջինիս լիազորությունների սահմաններից. «Նա նման կերպ քրեական գործ վարելու իրավասություն պարզապես չունի։ Քրեական գործով չի կարելի չհարցաքննել այն անձանց, որոնց մասով մտավախություն ունեն, թե կարող են հօգուտ մյուս կողմի ցուցմունք տալ։ Դա հակաօրինական է»։

 Արմեն Ֆերոյանը հայտարարեց՝ այդ հակաօրինականության արդյունքում տեսնում են ակնհայտ անարդար դատական ակտեր, և դա խոսում է այն մասին, որ դատարանների նկատմամբ տեղի են ունենում անասելի ճնշումներ. «Իմ և գործընկերներիս մոտ շատ մեծ հիասթափություն առաջացավ, երբ այդ անասելի մեծ ճնշումներին տուրք տվեց  ՀՀ Վճռաբեկ դատարանը՝ ի դեմս Հակակոռուպցիոն պալատի։ Իսկ սովորաբար ճնշում են այն մարդկանց, ովքեր ճնշվող են։  Իմ հիասթափափությունն այն է, որ Վճռաբեկ դատարանում այնպիսի մարդիկ էին, որոնց ամենահեշտը  ճնշեցին, և ունեցանք շատ մեծ արագության դատական ակտեր։ Շատ մեծ ապօրինի գործողությունների հետ գործ ունենք»։
