ՀԷՑ-ի լիցենզիայի չեղարկումը՝ պետական բռնագրավում, որն ավերում է Հայաստանի տնտեսական հիմքերը

Իշխանությունների ճնշման ներքո Հանրային ծառայությունները կարգավորող հանձնաժողովը չեղյալ հայտարարեց «Հայաստանի էլեկտրական ցանցեր» ընկերության լիցենզիան՝ այն վերածելով քաղաքական նպատակներով օգտագործվող «գործիքի» առաջիկա խորհրդարանական ընտրությունների համար։ Հանձնաժողովի նիստը պարզապես ձևականություն էր․ գույքը փաստացի բռնագրավելու որոշումը կայացված էր դեռ նիստից առաջ։

Լիցենզիայի չեղարկումն իր էությամբ գույքի բռնագրավում է, ինչը հակասում է ինչպես Հայաստանի Սահմանադրությանը, այնպես էլ միջազգային իրավունքին։ Պետությունը չի կարող օրենքի բացահայտ խախտմամբ սեփականաշնորհված ընկերությունը բռնազավթել՝ այն դարձնելով վարչական-քաղաքական շահերի սպասարկու։

Կոլեգիալ կառույցները պետք է ապահովեն շահերի հավասարակշռություն, հատկապես այն ոլորտներում, որոնք ներգրավում են միլիարդավոր ներդրումներ և ամբողջ երկրի էներգետիկ անվտանգությունը։ Այնուամենայնիվ, այս որոշումը փաստացի ընդունվեց մեկ պաշտոնյայի կամքով՝ շրջանցելով մասնագիտական տրամաբանությունն ու համակարգային փորձաքննությունը։

Գործող իշխանության այս քայլը ուղիղ հարված է Հայաստանի ներդրումային միջավայրին։ Տնտեսագետները միանշանակ են․ ոչ մի խելամիտ ներդրող Հայաստան չի մտնի, երբ տեսնում է, որ իշխանությունն առանց հիմնավորման, առանց դատարանի և առանց իրավական ընթացակարգերի կարող է մեկ գիշերում վերցնել ցանկացած ընկերություն։ Առաջինը, ինչի մասին ներդրողը մտածում է՝ այն վտանգներն են, որ իրեն սպասում են Հայաստանում՝ գույքի կորուստից մինչև վարչական շանտաժ։

Ներդրումների բացակայությունը երկիրն ուղիղ կանգնեցնում է քաոսի առաջ։ Եթե ներդրումային հոսքերը կանգնեն, ապա տնտեսական համակարգը պարզապես չի դիմանա։ Սկսվող կոլապսը կործանարար կլինի ոչ միայն բիզնեսների, այլև ամբողջ պետության համար՝ բերելով աշխատատեղերի կորստի, հարկային եկամուտների կտրուկ նվազման և տնտեսական անկարգությունների շղթայական հետևանքների։

ՀԷՑ-ի լիցենզիայի չեղարկումը պարզապես ընկերության դեմ քայլ չէ։ Դա պետական առևանգում է, որը վտանգում է երկրի ապագան՝ խարխլելով իրավական պետության հիմքերը և խոչընդոտելով տնտեսական զարգացումը։
