Կադաստրի կոմիտեն առաջարկում է ներդնել «հետադարձ հիփոթեք» և «կողակցի սեփականության իրավունք» ինստիտուտները

Կադաստրի կոմիտեն նախաձեռնել է նոր օրենսդրական փոփոխություն, որով առաջարկվում է ՀՀ քաղաքացիական օրենսգրքում ներդնել  «հետադարձ հիփոթեք» և «կողակցի սեփականության իրավունք» ինստիտուտները, որոնք հնարավորություն կտան կենսաթոշակային տարիքի հասած քաղաքացիներին, որոնք ունեն սեփական բնակարան, տուն կամ այգետնակ, գրավադրելու իրենց գույքը և դրա դիմաց ստանալու պարբերական եկամուտներ՝ առանց ողջ կյանքի ընթացքում վճարումներ կատարելու։

Գույքի նկատմամբ սեփականության իրավունքը պահպանվում է ամբողջ պայմանագրային ժամանակահատվածում։

Այսպիսով` քաղաքացիները կկարողանան իրենց գույքի արժեքի հաշվին ստանալ եկամուտ՝ շարունակելով պահպանել ինչպես սեփականության, այնպես էլ դա օգտագործելու, այդտեղ բնակվելու իրավունքը։

Նախագծով սահմանվում են էական երաշխիքներ․

• հետադարձ հիփոթեքի տարեկան տոկոսադրույքը չի կարող գերազանցել տվյալ պահին գործող հիփոթեքային վարկերի նվազագույն տարեկան տոկոսադրույքը,

• գույքը պարտադիր ապահովագրվում է, կատարվում են հարկային պարտավորությունները, հատուկ մեխանիզմների միջոցով պահպանվում է գույքի բարեկարգությունը,

• գրավատուի կամ նրա իրավահաջորդների պարտավորությունները չեն կարող գերազանցել գույքի իրացումից ստացված գումարի չափը,

•սահմանվում է նախնական խորհրդատվության պարտադիր պահանջ՝ ֆինանսական և իրավական ռիսկերը նվազեցնելու նպատակով։

 Կողակցի սեփականության իրավունքը միաժամանակ նախատեսում է, որ ամուսնության ընթացքում ձեռք բերված և ընդհանուր համատեղ սեփականություն հանդիսացող գույքը սեփականատերերի դիմումի հիման վրա կարող է գրանցվել որպես կողակցի սեփականություն, ինչի արդյունքում՝ամուսիններից մեկի մահից հետո կողակիցը շարունակում է սեփականության իրավունքով անխոչընդոտ տնօրինել և օգտագործել իր կենցաղային միջավայրը՝ բնակարանը կամ տունը՝ որպես մեկ ամբողջական գույքային միավոր, առանց այդ փուլում գույքը մյուս ժառանգների հետ բաժանելու անհրաժեշտության։

Ամուսնության ընթացքում գույքի գրանցումը որպես կողակցի սեփականություն նաև ապահովում է իրավական հստակություն և գույքային հարաբերությունների կանխատեսելի զարգացում՝ ամրապնդելով ամուսնու սոցիալական պաշտպանվածությունը։

Այս ինստիտուտները լայնորեն կիրառվում են մի շարք զարգացած երկրներում (ԱՄՆ, Կանադա, Մեծ Բրիտանիա)՝ ապահովելով սեփականության իրավունքի լիարժեք իրացում, ֆինանսական գործիքների ընդլայնում և քաղաքացիների համար ստեղծում են իրենց գույքի արժեքը կայուն եկամտի վերածելու նոր հնարավորություն։
