«Օրենքով գող» է ձերբակալվել․ ՔԿ

ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչությունում քննվող քրեական վարույթի նախաքննության ընթացքում ԱԱԾ աշխատակիցների հետ համատեղ իրականացված միջոցառումների արդյունքում պարզվել է, որ քրեական աստիճանակարգության բարձրագույն կարգավիճակ ունեցող անձը գործելով քրեական ենթամշակույթ կրող խմբավորման սահմանած և ճանաչած վարքագծի կանոնների համաձայն, ստեղծելով և ղեկավարելով քրեական աստիճանակարգությամբ ու միջանձնային հիերարխիկ հարաբերություններով օժտված անձանց միավորում, քրեական ենթամշակույթ կրող խմբավորման անդամներից տեղեկանալով, որ ՀՀ քաղաքացի Հ.Մ.-ն ՌԴ-ում ծավալած գործունեության ընթացքում մեծ գումարներ է վաստակել, նրանից պահանջել է 250 հզր ԱՄՆ դոլար գումարի չափով անօրինական օգուտ։ Այս մասին տեղեկանում ենք ՔԿ-ից։

Հ.Մ.-ի քույրը, տեղեկանալով նկարագրված խնդիրների մասին, դիմել է քրեական աստիճանակարգության բարձրագույն կարգավիճակ ունեցող Ս.Հ.-ին, ով քրեական ենթամշակույթ կրող խմբավորման հետապնդած նպատակների իրականացման և անօրինական օգուտ ստանալու նպատակով ստանձնել է առաջացած գումարային խնդրի լուծումը:

Արդյունքում, Ս.Հ.-ի և Գ.Մ.-ի միջև պայմանավորվածություն է ձեռք բերվել պահանջված գումարի փոխարեն առավել նվազ՝ 66 հզր ԱՄՆ դոլարին համարժեք 25 մլն 522 հզր 200 ՀՀ դրամ վճարելու շուրջ, որը տուժողի կողմից փոխանցվել է Գ.Մ.-ին:

Քրեական վարույթի նախաքննության ընթացքում Գ.Մ.-ի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ Քրեական օրենսգրքի 322-րդ հոդվածի 1-ին մասով (քրեական աստիճանակարգության բարձրագույն կարգավիճակ տալը կամ ստանալը կամ պահպանելը), 323-րդ հոդվածի 2-րդ մասի 5-րդ կետով (քրեական աստիճանակարգության բարձրագույն կարգավիճակ ունեցող անձի կողմից քրեական ենթամշակույթ կրող խմբավորում ստեղծելը կամ ղեկավարելը), իսկ Ս.Հ.-ի նկատմամբ՝ 322-րդ հոդվածի 1-ին մասով (քրեական աստիճանակարգության բարձրագույն կարգավիճակ տալը կամ ստանալը կամ պահպանելը):

Գ.Մ.-ն ձերբակալվել է, իսկ Ս.Հ.-ի վերաբերյալ կայացվել է ձերբակալման որոշում՝ դատարան ներկայացնելու համար:

Քրեական վարույթով նախաքննությունը շարունակվում է։

Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով։
