Արևմուտքը չի տեսնում, թե ինչպես է Հայաստանում հոշոտվում արդարադատությունը

Հայաստանում իրավական համակարգը շարունակում է խեղդվել քաղաքական պատվերների ծանրության տակ։ Արդեն մի քանի ամիս է՝ ազգային բարերար, գործարար Սամվել Կարապետյանը գտնվում է ապօրինի կալանքի տակ՝ մեղադրանքներով, որոնք անգամ դատարանը համարում է անհիմն։ Սակայն այդ իրավական աբսուրդը ոչ միայն չի դադարեցնում գործը, այլև օրեցօր վերածվում է քաղաքական հաշվեհարդարի բացահայտ դրսևորման։

Սամվել Կարապետյանի փաստաբանական խումբը վերջին հայտարարությամբ արձանագրել է մի շարք վտանգավոր զարգացումներ։ Հակակոռուպցիոն դատարանը, չնայած արձանագրել է, որ ներկայացված մեղադրանքներում չկա հիմնավոր կասկած, այնուամենայնիվ, մեկ ամսով երկարաձգել է կալանքը՝ իբր «նոր հանգամանքների» հիմքով։ Իրավական հիմքեր չլինելու պարագայում գործում է բացառապես քաղաքական տրամաբանությունը։ Դատարանի որոշման դեմ ներկայացված բողոքները մնացել են առանց պատշաճ քննության՝ անգամ Վճռաբեկ դատարանը, որն իրավունքի պահապանն է, ընտրել է «ընտրովի արդարադատության» ուղին՝ ընդունելով միայն դատախազության բողոքները և մերժելով պաշտպանական կողմինը։

Փաստաբանների հայտարարության մեջ հատուկ ընդգծվում է նաև Եվրոպական խորհրդարանի պատգամավոր Նաչո Սանչես Ամորիի հայտարարությունը՝ հնչեցրած Երևանում կայացած Եվրանեսթ-ի նիստում։ Նա հիշեցրել էր, որ խոսքի ազատությունը, հավաքների իրավունքը և քաղաքական բազմակարծությունը ժողովրդավարության հիմքն են և չեն կարող սահմանափակվել քրեական հետապնդումներով։ Կարապետյանի պաշտպանները ողջունում են այս խոսքերը, սակայն փաստում՝ դրանք մնում են ընդամենը գեղեցիկ ձևակերպումներ, եթե Եվրոպան աչք է փակում Հայաստանում տեղի ունեցող հստակ քաղաքական հետապնդումների վրա։

Ավելին, իրավապաշտպանները շեշտում են, որ նույն տիպի հետապնդումներ են իրականացվում նաև «Մեր ձևով» շարժման անդամների նկատմամբ՝ այդ թվում փաստաբան Ռուբեն Մխիթարյանի ապօրինի ձերբակալությունը Գյումրիում, ինչպես նաև եկեղեցականների նկատմամբ իրականացվող անհիմն կալանքները։ Սա խոսում է մի համակարգի մասին, որտեղ քաղաքական շահը վաղուց է վերածվել դատական պրակտիկայի։

Այս ֆոնին Արևմուտքի լռությունը միայն խրախուսում է իրավական անարխիան։ Այն, ինչ այսօր կատարվում է Հայաստանում, հիշեցնում է ոչ թե ժողովրդավարական պետություն, այլ մի իշխանական մոդել, որտեղ արդարադատությունը ծառայում է միայն վերնախավի շահերին։ Եվ եթե Եվրոպան իսկապես ցանկանում է տեսնել ժողովրդավար Հայաստան, ապա պետք է սկսի ոչ թե Բրյուսելից հնչող հայտարարություններով, այլ այստեղ՝ տեսնելով, թե ինչպես է խեղդվում խոսքի ազատությունն ու խոցվում իրավունքի գերակայությունը։

Իրական եվրոպական ինտեգրումը չի չափվում ասուլիսներով և կոմունիկեներով։ Այն չափվում է նրանով, թե որքան ազնիվ է պետությունը սեփական քաղաքացիների նկատմամբ։ Իսկ այսօր Հայաստանը գնում է հակառակ ուղղությամբ՝ դեպի փակ դատարաններ, ընտրովի արդարադատություն և քաղաքական բանտարկյալներ։ Եվ եթե Արևմուտքը շարունակի չտեսնելու տալ այս ամենը, ապա հենց իր իսկ հռչակած արժեքներն են դառնում կեղծ խոսքեր՝ անգործության և կույր լռության պատյանում։
