Միջազգային քրեական դատարանը մերժել է Նեթանյահուի և Գալանտի ձերբակալման օրդերները բողոքարկելու Իսրայելի միջնորդությունը

Միջազգային քրեական դատարանը (ՄՔԴ) ուրբաթ մերժել Է Իսրայելի միջնորդությունը՝ Գազայի պատերազմի հետ կապված վարչապետ Բենիամին Նեթանյահուի և պաշտպանության նախկին նախարար Յոավ Գալանտի ձերբակալման հրամանները բողոքարկելու վերաբերյալ, հաղորդում Է AFP-ն:

Այն որոշման մեջ, որը գլխագրեր էր զբաղեցրել ամբողջ աշխարհում, Միջազգային քրեական դատարանը նոյեմբերին «հիմնավոր պատճառներ» էր գտել ենթադրելու, որ Նեթանյահուն և Գալանտը քրեական պատասխանատվություն են կրում Գազայում ենթադրյալ ռազմական հանցագործությունների և մարդկության դեմ հանցագործությունների համար։ Միջազգային քրեական դատարանը նաև ձերբակալման օրդերներ էր տվել պաղեստինյան ՀԱՄԱՍ խմբավորման երեք բարձրաստիճան ղեկավարների նկատմամբ, սակայն չեղարկել էր դրանք նրանց մահից հետո։

Նեթանյահուի և Գալանտի ձերբակալման օրդերները վրդովմունք են առաջացրել Իսրայելում, ինչպես նաև Միացյալ Նահանգներում, որը հետագայում պատժամիջոցներ է կիրառել Միջազգային քրեական դատարանի բարձրաստիճան պաշտոնյաների նկատմամբ։

Նեթանյահուն որոշումը որակել է որպես «հակասեմական», իսկ ԱՄՆ այն ժամանակվա նախագահ Ջո Բայդենն այն անվանել է «անարգալից»։

Մայիսին Իսրայելը դիմել էր դատարան՝ խնդրելով չեղարկել օրդերները, մինչդեռ նա քննում էր առանձին հարց այն մասին, թե արդյոք Միջազգային քրեական դատարանն իրավազորություն ունի այդ գործով, թե ոչ։

Հուլիսի 16-ին դատարանը մերժել է այդ միջնորդությունը՝ հայտարարելով, որ «իրավական հիմքեր չկան» օրդերները չեղարկելու համար, քանի դեռ քննվում է իրավազորությունը վիճարկելու հարցը։ Մեկ շաբաթ անց Իսրայելը թույլտվություն է խնդրել այդ որոշումը բողոքարկելու համար, սակայն ուրբաթ օրը դատավորները որոշել են, որ «Իսրայելի կողմից ձևակերպված հարցը ենթակա չէ բողոքարկման»։

Միջազգային քրեական դատարանի դատավորները դեռևս քննարկում են Իսրայելի իրավասության վերաբերյալ ավելի լայն վեճը։ Երբ դատարանը սկզբնապես նոյեմբերին ձերբակալման օրդերներ է տվել, այն միաժամանակ մերժել է իր իրավասության վերաբերյալ Իսրայելի բողոքարկումը։

Սակայն ապրիլին Միջազգային քրեական դատարանի Վերաքննիչ պալատը որոշել է, որ Նախնական վարույթի պալատը սխալ էր թույլ տվել՝ մերժելով բացարկը և հրամայել է նրան ևս մեկ անգամ մանրամասն ուսումնասիրել Իսրայելի փաստարկները։ Պարզ չէ, թե երբ այն որոշում կկայացնի այդ հարցի շուրջ։
