Ամստերդամ. «Սամվել Կարապետյանի գործը քաղաքական հաշվեհարդար է՝ քողարկված իրավական ձևակերպումներով»

Սամվել Կարապետյանի միջազգային փաստաբան Ռոբերտ Ամստերդամը հոկտեմբերի 14-ին հրավիրված ասուլիսի ընթացքում հայտարարեց, որ գործարարի դեմ հարուցված մեղադրանքներն ամբողջությամբ քաղաքական բնույթ ունեն և ուղղված են մեծ հեղինակություն ունեցող գործչին՝ վախեցնելու նպատակով։ Նրա խոսքով՝ «Ադրբեջանի կառավարությունը երկու հայ միլիարդատերի հետևից է ընկել՝ Ռուբեն Վարդանյանի և Սամվել Կարապետյանի», և այս գործընթացը վտանգավոր նախադեպ է ամբողջ տարածաշրջանի համար։

Ամստերդամը հիշեցրեց, որ Սամվել Կարապետյանը կալանավորվել է այն ժամանակ, երբ Հայաստան էր ժամանել՝ իր հոր քառասունքին մասնակցելու համար․ «Դա որևէ քաղաքական ակցիա չէր։ Ելնելով խոսքի համատեքստից՝ պարզ է, որ պարոն Կարապետյանի մտքով անգամ չէր անցել ակնարկել կառավարության տապալման մասին։ Այս ամենի հիմքում մի վախեցած վարչապետի անհանգստությունն է՝ իր սեփական ժողովրդի և եկեղեցու հանդեպ»։

Փաստաբանը ընդգծեց, որ գործի ամբողջ ընթացքը ցույց է տալիս իրավական մեխանիզմների քաղաքական շահարկում։ «Մինչև հունիսի 17-ը նա նույնիսկ որպես վկա ներգրավված չէր, իսկ մի օրում՝ առանց հիմքի, ներկայացվեց մեղադրանք՝ “կառավարության տապալման կոչ” ձևակերպմամբ։ Այնուհետև ավելացվեց նաև “փողերի լվացման” հոդվածը։ Սա ավտոկրատական ռեժիմների դասական գործելաոճն է՝ ազատվել սեփական վախերի խորհրդանիշ դարձած մարդկանցից»,— նշեց Ամստերդամը։

Նրա համոզմամբ՝ այս գործով խախտվել են Մարդու իրավունքների եվրոպական կոնվենցիայի մի շարք հիմնարար հոդվածներ՝ դավանանքի ազատությունը (հոդված 9), արտահայտման ազատությունը (հոդված 10) և քաղաքական հետապնդման արգելքը (հոդված 18)։ «Մենք դիմելու ենք Եվրոպական միությանը՝ պահանջելով դատապարտել Հայաստանի կառավարությանը քաղաքական բանտարկյալներ պահելու համար։ Այս գործը հասնելու է ոչ միայն միջազգային ատյաններ, այլև բոլոր այն կենտրոնների, որոնք կարող են ազդել Երևանի վրա»,— ասաց նա։

Ամստերդամը նաև նշեց, որ «Հայաստանի կառավարությունն իրեն պահում է ավելի վատ, քան ամենահետամնաց աֆրիկյան երկրները», հավելելով, որ նույնիսկ Տանզանիայում, որտեղ ինքն այժմ պաշտպանում է ընդդիմության իրավունքները, նման գործով իշխանությունները «կամաչեին»։ Նրա խոսքով՝ իշխանությունը փորձում է հեղինակազրկել Սամվել Կարապետյանին՝ կանխելու համար նրա հանրային աջակցությունը և հնարավոր քաղաքական վերելքը։

«Սամվել Կարապետյանի ազատազրկումը ցույց է տալիս գործող իշխանության վախը։ Փաշինյանը, ով պարբերաբար հանդես է գալիս ֆեյսբուքյան վիրավորական ուղերձներով, այսօր հարձակվել է մարդու վրա, որը պարզապես մասնակցում էր իր հոր հոգեհանգստին։ Սա ոչ թե դատական, այլ բարոյական ողբերգություն է»,— հայտարարեց Ամստերդամը՝ հավելելով, որ իր թիմը շարունակելու է պայքարը մինչև Կարապետյանի ազատ արձակումը։

Փաստաբանի խոսքով՝ Սամվել Կարապետյանի գործը վաղուց դուրս է եկել մեկ անձի սահմաններից․ այն դարձել է ազատության, արդարության և պետական պատասխանատվության փորձաքարը։ «Այս ամենը պետք է դադարեցվի, քանի դեռ Հայաստանը չի վերածվել քաղաքական վախերի երկրամասի։ Մենք չենք լռելու, քանի դեռ այստեղ պահվում են քաղաքական բանտարկյալներ»,— եզրափակեց Ռոբերտ Ամստերդամը։
